The purpose of this
article is to establish a beautification commission known as the "Ocean
Township Beautification Committee."
A.
The members of the Committee shall be nominated by the Mayor and
appointed with the advice and consent of the Township Committee. The
members of the Beautification Committee shall annually choose from
its members the chairperson and such other officers as it may deem
necessary.
B.
The Committee shall consist of five regular members and two alternate
members who are residents of the municipality. A quorum is necessary
for the purpose of voting and a quorum shall consist of four or more
members.
C.
Two alternate members shall be appointed and designated as "Alternate
No. 1" and "Alternate No. 2." Their term(s) shall be distributed evenly
over the first two years following appointment; Alternate No. 1 shall
serve an initial appointment of two years; Alternate No. 2 shall serve
an initial appointment of one year. Thereafter the term of each alternate
member shall be for five years.
D.
Alternate members shall be participating members but shall not be
permitted to vote unless a regular board member is absent or is unable
to vote due to a conflict. Alternate members shall be counted for
the purposes of establishing a quorum.
E.
The members of the Beautification Committee shall serve without compensation.
The terms of each member shall be for five years. The initial
term of the first Committee members shall expire on December 31 of
the first, second, third, fourth and fifth years next ensuing after
the date of their appointment. One member shall be appointed for one
year, one member for two years, one member for three years, one member
for four years and one member for five years. At the expiration of
each of the above terms, new members and members reappointed shall
serve for a term of five years and until their successors are appointed
and qualify.
Any member who is appointed and accepts to serve on the Beautification
Committee shall within 90 days of acceptance have passed the certification
course. Refusing to sit or failing the certification course within
90 days of appointment shall constitute grounds for revocation of
the appointment. Written notice by the Township Committee shall be
forwarded to the Committee member appointee stating their disqualification
and removal.
To effectuate its purposes, the Beautification Committee shall
have the power to:
This Committee is created and formed for the following purposes:
A.
Exercise full and exclusive control over the regulation, planting
and care of shade and ornamental trees and shrubbery now located,
or which may hereafter be planted, in any public highway, park or
parkway, except such as are excluded pursuant to N.J.S.A. 40:64-1
in the municipality for which it was created, including the planting,
trimming, spraying care and protection thereof;
B.
Regulate and control the use of the ground surrounding the same,
so far as may be necessary for their proper growth, care and protection;
C.
Move or require the removal of any tree, or part thereof, dangerous
to public safety;
D.
Care for and control such parks and parkways; encourage arboriculture;
make, alter, amend and repeal, in the manner prescribed for the passage,
alteration, amendment and repeal of ordinances by the governing body
of the municipality, any and all ordinances necessary or proper for
carrying out the provisions hereof;
E.
Administer treatment to, or remove, any tree situated upon private
property which is believed to harbor a disease or insects readily
communicable to neighboring healthy trees in the care of the municipality
and enter upon private property for that purpose, with the consent
of the owner thereof, provided the suspected condition is first confirmed
by certificate issued by or on behalf of the department of agriculture.

The Beautification Committee shall submit a report to the Township
Committee each December. Those reports shall be submitted by December
15 each year, and shall include Committee activities since the last
report and any results and pending results.
B.
The Committee shall also certify to the Township Committee the estimated
sum necessary for the proper conduct of its work during the ensuing
fiscal year, which shall include the sums estimated to be expended
for:
(1)
Payment of wages and salaries of employees,
(2)
Expenses of Committee members in discharging official duties, including
expenses incident to attendance at professional meetings.
(3)
Purchase of trees and shrubbery; and
(4)
Purchase of necessary equipment and materials and the cost of services
for the prudent promotion of the work.
