A permit must be obtained through the system outlined in this article before any person engages in the activity described in § 185-7, Permits required, unless the activity is scheduled by the Town.
Application shall be made to the Parks and Recreation Department
at least 48 hours prior to the proposed activity date.
Application shall be made on a form provided by the Parks and
Recreation Director specifying the name, address, and phone number
of the sponsoring organization, if any, the date and the type of proposed
activity, the park which has been requested, the estimated attendance,
and the hours, during which the activity is to be conducted.
The Parks and Recreation Director or his designee shall issue
a permit if the applicant's use will not materially interfere
with the enjoyment and use of Town parks by the general public based
on consideration of whether the applicant's activity:
A.
Will detract from residents' entitlement to recreation;
B.
Will unreasonably infringe on public health, safety, or welfare;
C.
Will conflict with facilities reserved for other uses;
D.
Will interfere with traffic or burden police services;
E.
Is likely to cause personal or property injury, incite violence,
crime, or disorderly conduct; or
F.
Is for the primary purpose of advertising products, goods or events,
or for private profit.
The Parks and Recreation Director may impose reasonable conditions
relating to the safety, health and welfare of the park users.
As a condition of the issuance of a permit, the Parks and Recreation
Director, may at his discretion, require the posting of a bond for
damages to any Town property and may require the individual or group
to have in attendance a law enforcement officer.
The Parks and Recreation Director shall act on an application
within five business days of the receipt thereof. Denial of an application
shall be accompanied by a statement of reasons for such denial. An
applicant may appeal the action of the Parks and Recreation Director
to the Town Manager.
Any permit is revocable for violation of this chapter or for
breach of the conditions attached to the permit.
Town Council retains the right to review permits and denials
on an individual basis.
