No person shall make any use of any facility maintained by the Town for the collection or disposal of garbage, refuse, or other waste materials unless he shall first have obtained from the Department of Public Works a permit for such use. Such permit shall be in the form prescribed by the Department.

The Department of Public Works shall issue the permit in § 232-1 only to the following persons:
A. 
Residents of the Town;
B. 
Any nonresident person owning or leasing real property within the Town, provided that any such permit shall be limited to the disposal of waste materials generated by activities carried on within the Town.
C. 
Any person engaging in the business of collecting waste material from residents of the Town or from activities carried on within the Town, provided that such permit is limited to the disposal only of waste materials so collected.

The Department of Public Works shall issue the permit described in § 232-1 upon application of any person enumerated in § 232-2 without payment of any fee.

Any person violating the provisions of this article shall be subject to a penalty not exceeding $50 for each offense.

It shall be unlawful for any persons to make deposits of refuse, whether boxed, bagged, or otherwise, at the entrance to the Town transfer station at any time. People utilizing the facilities of the transfer station must deposit their refuse where instructed by the station operator.

Violators of this article shall be subject to a minimum of a $50 fine on the first offense and $100 for the second offense.
