The short title of this article shall be the "Environmental
Advisory Commission," and the same may be cited in that manner.
It is hereby established that the Environmental Advisory Commission
(hereinafter referred to as "EAC") shall be an advisory commission
and shall remain in existence until an ordinance terminating its existence
is passed by the Borough Council.
A.Â
The Environmental Advisory Commission shall be made up of seven members who shall be appointed by the Borough Council. The seven members or Commissioners shall consist of the following: five Borough residents, one nonresident who is a Borough property owner, and one student member, said student being either a Kutztown University student residing in the Borough or on the campus of Kutztown University, or a student at Kutztown Area High School, who resides within the Borough of Kutztown. Each member shall be appointed for a term of three years except for original appointments which are specified in Subsection C below or until his/her successor takes office.

The EAC shall annually elect one of its members to serve as Chairperson
and elect such other officers and adopt procedural rules and regulations
as it deems appropriate.
C.Â
The initial terms of all members of the EAC shall be deemed at their
appointment and end as follows: two residents shall be appointed for
terms of one year; two residents shall be appointed for terms of two
years; two residents shall be appointed for terms of three years;
and the lone student representative shall be appointed for a term
of two years.
D.Â
The student representative on the EAC shall be allowed to serve his/her
term on the EAC for as long as he/she is enrolled as a student at
either Kutztown Area School District or Kutztown University and resides
within the Borough of Kutztown or on the campus of Kutztown University.
In the event that the student member on the EAC no longer meets the
requirements, his/her membership on the EAC shall be terminated, and
the Borough Council shall appoint a new student representative meeting
the qualifications of the student member.
The Borough Council of the Borough of Kutztown shall accommodate
one of its members to serve as the Borough Council's liaison
to the Borough of Kutztown Environmental Advisory Commission. The
Council liaison shall have the ability to engage in the discussion
of the EAC and to provide useful input to the EAC. However, the Council
liaison shall not have a vote in the affairs of the EAC nor shall
be/she be eligible for election as an officer of the EAC.
A.Â
The purpose of the EAC shall be to advise the Borough Council on
all environmental issues confronting the Borough and to make recommendations
regarding the Borough's environmental policies.
B.Â
The EAC's duties shall include the following:
(1)Â
To serve as a clearinghouse for information and forum for inquiries
and issues of an environmental nature from citizens and any other
board or commission and to assist in answering the inquiry and/or
resolving the issue presented.
(2)Â
When requested or necessary, to recommend plans and programs to the
appropriate agencies for identification and resolution of environmental
problems, promotion and conservation of natural resources and for
the protection and improvement of the quality of the environment within
the Borough of Kutztown.
(3)Â
To encourage voluntary environmental programs and community participation
therein.
(4)Â
To undertake such other environmental tasks as requested by the Borough
Council.
(5)Â
To apply for and receive grants and expend funds appropriated for
its use for the purposes set forth in this subsection, provided that
no expense may be incurred by the EAC without the prior approval of
the Borough Council of the Borough of Kutztown.
C.Â
The EAC shall file an annual report with the Borough Council which
shall contain recommendations concerning the Borough's environmental
policies and methods to improve thereon. The report shall also set
forth an outline of the EAC's goals and objectives for the upcoming
year.
