The following words when used in this Part shall have the meanings ascribed to them in this section except in those instances where the context clearly indicates a different meaning:
ACCESS TO THE DRAINAGE SYSTEM
A situation where a portion of the drainage system exists anywhere immediately surrounding a property. A lot shall be considered to have access to the drainage system if any existing storm sewer is located anywhere in front of any property's lot line.
DRAINAGE SYSTEM
That portion of the storm sewer and/or drainpipes, gravity cellar drains and sump pump lines (unless otherwise permitted) used with respect to any dwelling, land or tenement in conducting the surface water from those places to its eventual outlet into a natural or permitted watercourse.
DRAINPIPE
A pipe or series of pipes having an inside diameter of not less than four inches or more than eight inches buried in any street or alley in the Borough, including only that portion of the pipes extending from the main to the curb or alley line, and now or in the future used for collecting and discharging into the natural streams in and surrounding the Borough surface water accumulating on real estate, lands and tenements within the Borough and conducted from those places through gravity cellar drains or sump pump lines provided for that purpose.
GRAVITY CELLAR DRAIN
Any pipe leading from the cellar of a dwelling within the Borough and feeding by gravity into the drainage system at the curb or alley line.
STORM SEWER
A pipe or series of pipes buried in a street or alley having a diameter of more than eight inches now or in the future used for the collection and discharge into natural streams in and surrounding the Borough all clear surface and storm water accumulating on streets within the Borough, as well as in and upon real estate, lands and tenements in the Borough and conducted from those places through gravity cellar drains or sump pump lines provided for that purpose.
STREET RECONSTRUCTION
Anytime Borough Council shall decide to improve a street by either: (a) a complete replacement of all asphalt in the cartway, or (b) a replacement or new installation of a storm sewer followed by an overlay of asphalt upon the street.
SUMP PUMP LINE
Mechanical device forcing a pressurized flow through a pipe with a maximum diameter of three inches leading from the cellar of a dwelling within the Borough and connecting with the drainage system at the curb or alley line.

Every owner of improved real estate in the Borough shall construct and/or maintain that portion of the system known as the gravity cellar drain or sump pump line.
A. 
Gravity Cellar Drain. Any dwelling or other improved real estate in the Borough which has access to the drainage system and utilizes a gravity cellar drain shall be connected with the drainage system. The owner of the premises shall execute forms provided by the Borough and pay a connection fee as established by resolution of Borough Council. In the event that the Borough provides labor and/or material and pipe to meet the gravity cellar drain of the applying owner, that cost shall, in addition to the connection fee, be charged to that owner.
B. 
Sump Pump Line. Any dwelling or other improved real estate in the Borough which has access to the drainage system and utilizes a sump pump must connect by pipe into the drainage system. The forms and fees paying for a connection into the drainage system are identical with those defined under gravity cellar drains in this section.

Every gravity cellar drain constructed in the future shall be at least four inches in diameter, except in special circumstances where at the discretion of the Borough Manager they shall be not less than that of the drain pipe or storm sewer into which the cellar drain is proposed to be connected.

Every sump pump line connected into the drainage system shall be a maximum diameter of three inches or less, except in special circumstances where at the discretion of the Borough Manager they may be increased in size if it is determined that they will not surcharge that portion of the existing drainage system.

Every gravity cellar drain and sump pump connected into the drainage system shall at all times be kept open and free for the passage of water by the property owners; and that owner shall provide a screen for the gravity cellar drain in order to prevent dirt or material other than clear water from obstructing the passage of it; and the property owner shall, in every possible respect, minimize the flow of water through their system. No substances or material other than clear water may be discharged through gravity cellar drains or sump pump lines.
2. 
All gravity cellar drains and sump pump lines constructed in the future shall be prohibited from permanently discharging onto Borough sidewalks. Also, all gravity cellar drains and future sump pump lines shall be prohibited from discharging into the street if any acceptable alternate means of discharge exists except in special circumstances subject to the discretion of the Borough Manager.

In the event that a stoppage or obstruction shall exist in the drainage system affecting or endangering the premises connected to the system, the owner of the premises shall notify the Borough Manager, if he or she has reason to believe that the stoppage or obstruction exists in the drainage system at a place other than the gravity cellar drain or sump pump line. That owner may, upon reporting of the stoppage or obstruction, request assistance from the Borough by depositing with the Borough a sum of $100. Upon deposit of that sum, it shall be the duty of the Borough Manager to open or cause to be opened the drain pipe or storm sewer in the vicinity of the affected premises within a reasonable time thereafter and to remedy or cause to be remedied the obstruction if located within the drain pipe or storm sewer.

In the event that by opening of the drain pipe or storm sewer, no obstruction or stoppage in the transit of water is found, or in the further event that the stoppage or obstruction is found to be in the gravity cellar drain or sump pump line of the property from where the report of the stoppage or obstruction originated, the Borough shall retain for its own use the $100 deposit plus charge the property owner any incremental costs incurred in opening and uncovering the storm sewer or drain pipe or other part of the drainage system. Conversely, if the Borough determines the stoppage or obstruction is within the Borough portion of the drainage system, the $100 deposit will be returned to the property owner.

All costs charged or incurred under this Part, including any annual rental as may in the future be assessed by Council for the use of the drainage system of the Borough, may be collected in the manner provided by law for the recovery of municipal claims.

If Borough Council shall decide to reconstruct a street, all property owners who have access to the drainage system shall be required to connect their existing or future gravity cellar drain or sump pump line into the Borough's drainage system. Such connection of an existing gravity cellar drain or sump pump line shall be completed within 60 days after the completion of the street reconstruction.

Any person who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine not exceeding $600 and costs and, in default of payment thereof, shall be subject to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
