A. 
The Uniform Fire Safety Act, (P.L. 1983, c. 383)[1] was enacted for the purpose of establishing a system for the enforcement of minimum firesafety standards through the State of New Jersey. The Uniform Fire Safety Act authorizes municipalities to provide for local enforcement and to establish local enforcement agencies for that purpose; and it is in the best interest of the Township of Evesham to have the Uniform Fire Safety Act enforced locally.

The Board of Fire Commissioners of Evesham Township Fire District No. 1 have agreed to the plan, which is set forth herein, for the administration and enforcement of the Uniform Fire Safety Code.
Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383)[1] the New Jersey Uniform Fire Code shall be locally enforced in the Township of Evesham.

The local enforcing agency within the entire jurisdiction boundaries of Evesham Township shall be the Division of Fire Prevention, which shall consist of the Fire Official and his staff.
The local enforcing agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the boundaries of Evesham Township, other than owner-occupied one-and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and Uniform Fire Code.
The local enforcing agency established by § 75-3 of this chapter shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
The local enforcing agency established by § 75-3 of this chapter shall be a part of the Fire District and shall be under the supervision of the Fire Official, who shall report to the Board of Fire Commissioners of Evesham Township Fire District No. 1, or such officer as the President of the Board of Fire Commissioners may designate.
A. 
The local enforcing agency shall be under the direct supervision of the Fire Official, who shall be appointed by the Board of Fire Commissioners of Evesham Fire District No. 1. The Fire Official shall be responsible for enforcing not only the Uniform Fire Code but also the Municipal Fire Safety Enforcement Code.
B. 
Term of office. The Fire Official shall serve one-year-increment terms or until his successor is appointed. Any vacancy shall be filled for the unexpired term.
C. 
Inspectors and employees. The Board of Fire Commissioners shall appoint such inspectors and employees as may be necessary to carry out all required inspection activity in the Fire District. Such inspectors shall be under the supervision and control of the Fire Official.
D. 
Removal from office. The Fire Official, inspectors and other employees of the enforcing agency shall be subject to removal by the Board of Fire Commissioners for inefficiency or misconduct. Each employee to be so removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,[1] any person aggrieved by any order of the local enforcing agency shall have the right to appeal to the Construction Board of Appeals of Evesham Township, if then in existence, and if not, then to the Burlington County Board of Appeals.

Multiple business occupancy shall include all buildings and structures or parts thereof which are used for the purposes that meet the requirements of Use Group B and which comprise a multiplicity of rooms, suites or areas to accommodate multiple business occupancies, not to exceed 30 in number, which are rented from a common owner. The owner, who shall control access to all areas, shall provide basic services as are needed for the tenants to conduct their business, at their option. These services may include but are not limited to clerical, phone answering and message taking, photocopying and reproduction, mail services, security and secretarial and stenographers.

B. 
Fire safety use groups defined. For the purposes of uniformity, use groups of all buildings contained in this section of this chapter shall be defined using the International Building Code. Such buildings shall be subject to the registration and periodic inspection requirements established by this chapter. Where two or more fire safety uses exist at the same building or premises, each one shall be considered as separate and distinct for the purposes of this chapter and shall be registered pursuant to the provisions of this chapter.

C. 
Doubtful firesafety use classification. When a building or structure is not specifically classified within a firesafety use group, such building or structure shall be included in the firesafety use group it most nearly resembles in respect to the existing life and fire hazard, and it shall be so classified by the Fire Official.
D. 
Vacant buildings. The annual inspection fee for all vacant buildings shall be in accordance with the previous use of the building.
E. 
Required inspections. All firesafety uses shall be inspected annually for compliance with the provisions of this chapter and the Uniform Fire Safety Act.[1] When in the opinion of the Fire Official there exist conditions likely to cause fire, contribute to the spread of fire, interfere with fire-fighting operations, endanger life or violate the provisions or intent of this chapter, additional inspections may be made as often as necessary for the purpose of ascertaining these conditions and causing them to be corrected.

F. 
Payment of fees. The owner of the building is responsible to register and pay the fee for buildings containing common or public areas. The tenant/occupant is responsible to register and pay the fee for the space occupied by the tenant/occupant. All registrations will be for a period of one year and are not subject to refund or proration.
G. 
Registration of buildings and annual fees.
(1) 
Every owner or tenant/occupant subject to this section shall file with the local enforcing agency, using forms provided by the local enforcing agency, for a certification or registration. The application shall include but not be limited to the name, address and telephone number of the applicant; name, address and telephone number of the business; owners of the business; description of the business; the name, address and telephone number of the person responsible for the business; and emergency contact information as requested.
(2) 
If the owner or tenant/occupant subject to this chapter fails to complete the registration within 30 days of the date on which it was mailed, the local enforcing agency shall order the owner or tenant/occupant to pay a penalty equal to double the scheduled registration fee.
(3) 
Every owner or tenant/occupant subject to this chapter shall pay to the local enforcing agency an annual registration fee in the amount specified in this chapter. Said annual registration fee shall be paid by the date specified in the invoice, which shall in no event be less than 30 days from the date on which it was mailed.
H. 
Enforcement. If any annual registration fee or any penalty for nonregistration is not paid within 30 days of its stated due date, the same may be sued for and recovered by and in the name of the local enforcing agency in a civil action by a summary proceeding under the Penalty Enforcement Law (N.J.S.A. 2A:58-1 et seq.)[2] in the Evesham Township Municipal Court.

No permit fee shall be charged to a nonprofit organization as defined by and in compliance with the New Jersey Charitable Registration and Investigation Act of 1994 (N.J.S.A. 45:17A-18 et seq.).

A. 
Designation. The Fire Official may require and designate public or private fire lanes and/or fire zones as deemed necessary for the efficient and effective uses of fire apparatus. Unless stated to the contrary, the phrases "fire lanes" and "fire zones" shall be identical in meaning and used interchangeably.
B. 
Designated fire lanes and fire zones. The following areas, which shall be appropriately posted with notices indicating "no parking-fire zones" and which shall be marked with yellow lines at least four inches wide, are hereby designated fire lanes.
(1) 
Allison Apartments. Block 12, Lot 1, 31 North Maple Avenue. Parking is prohibited along either side of main entrance roads connecting designated parking areas.
(2) 
Camelot Apartments. Block 3.01, Lot 42, and Block 3.11, Lots 4 and 5. Parking is prohibited along either side of main entrance roads, along either side of both access roads leading to the rear housing area and along the curbline in front of any building complex.
(3) 
Nieuw Amsterdam Apartments. Block 10.6, Lot 3, 37 North Maple Avenue. Parking is prohibited along both sides of the throughway road between North Maple Avenue and North Locust Avenue, along either side of access roads leading to rear parking areas.
(4) 
65 Route 70 East (Plaza 70 Shopping Center). Block 4.09, Lot 21. Parking is prohibited along either side of the access road leading to said shopping center from any main highway and side streets, along the entire frontage of stores from the curbline out to the designated parking area. Parking is also prohibited along the rear of the shopping center from the building to 10 feet out to the access road that runs along the rear of the building.
(5) 
Staples Plaza Shopping Center. Block 3.02, Lot 3. Parking is prohibited along the entire frontage of stores from the curbline out the designated parking areas, within a twenty-foot radius from the center of all side and rear exits.
(6) 
125 East Main Street, Block 26, Lot 7.01. Parking is prohibited along the curb on the north and east sides of the building.
(7) 
1,001 - 003 Lincoln Drive West. Block 1.10, Lots 1, 2, 3, 4, 5. Parking is prohibited along the entire west side access road that runs parallel with Lincoln Drive West. Parking is also prohibited along the curbline throughout the complex except for the designated parking areas.
(8) 
301-319 Route 70 West (Shopping Center). Block 21, Lot 17 & 9. Parking is prohibited along all store frontages from the curbline to the designated parking area. Parking is also prohibited on the east and west sides of the building, from the building to the designated parking areas or fence line. Parking is limited to loading areas along the north side of the entire building.
(9) 
Greentree Square Shopping Center. Block 6.04, Lots 2 and 3. Parking is prohibited along all store frontages and the rear of the entire shopping center except in designated parking areas. Parking is also prohibited for 10 feet on either side of the building separation along the curb located 100 feet from the most southern point of the building.
(10) 
300 Greentree Road (Shopping Center). Block 8.16, Lot 1. Parking is prohibited on both sides of the rear access road, beginning at the point even with the front building line curb at the west end of the complex and continuing along said road to a point even with the front building line curb at the east of the complex.
(11) 
100 Brick Road (Office Building). Block 26, Lot 5.03. Parking is prohibited on both sides of the access road, beginning at the entrance at Brick Road and continuing in a northerly direction to the front of the complex to the south access road to the hospital parking area. Parking is also prohibited along the front of the building except the loading/unloading zone.
(12) 
90-99 Brick Road (Hospital Complex). Block 26, Lot 5.01. Parking is prohibited along both sides of the rear access beginning at the southeast entrance from Brick Road continuing north to the designated parking area at the extreme northeast end of the property. Parking is also prohibited on both sides of the front entrance beginning at the southwest entrance from Brick Road continuing north to the intersection in which the roadway turns east and continuing to the roadway directly in front of the building to the designated parking area. Parking is also prohibited on both sides of the western entrance where the road turns east parallel to the front of the building to the designated parking of 92 Brick Road. Parking is also prohibited at the curbline between the area designated for ambulance parking at the Emergency Department access.
(13) 
700 Route 73 North (Movie Theater). Block 6.04, Lot 5. Parking is prohibited along the entire front of the building (west side), along the south side to the handicap parking area, and continuing south to the point where the curb turns east, and continuing in a northerly direction along the entire rear of the building then along the north side of the building to the handicapped parking area and continuing to the remainder of the north side. Parking is prohibited from the curbline to the designated parking area.
(14) 
9000 and 10000 Lincoln Drive East (Greentree Center 1 and 2 Greentree Center). Block 51.01, Lots 53 and 54. Parking is prohibited before the entrance to the Fire Department access land (wide sidewalk), east side access lane of the facility. Parking is also prohibited along either side of the exits, north and south sides of both facilities.
(15) 
T.G.I. Friday's as listed on the current Tax Map of Evesham Township as Block 6.04, Lot 3. Parking is prohibited along the front of the building beginning at a point by the handicapped parking area.
(16) 
8000 Lincoln Drive East. Block 2.04, Lot 1. Parking is prohibited around the entire perimeter of the building from the curbline out to designated parking areas.
(17) 
7000 Lincoln Drive East. Block 2.04, Lot 1. Parking is prohibited around the entire perimeter of the building from the curbline out to designated parking areas.
(18) 
Midrise III (3 Greentree Center) 7001 Lincoln Drive West. Block 3.33, Lot 1. Parking is prohibited along the west side of the building, from the curb out to the designated parking areas. Parking is also prohibited along either side of the access roads and also the access road side of the traffic islands leading to and through the facility areas.
(19) 
8001-8004 Lincoln Drive West. Block 3.34, Lot 1. Parking is prohibited along the perimeter access roads from the curb to the designated parking areas and also along the access roads leading to the facility.
(20) 
9001-9004 Lincoln Drive West. Block 3.34, Lot 1. Parking is prohibited along the perimeter access roads from the curb to the designated parking areas and also along the access roads leading to the facility.
(21) 
755 Route 70 West. Block 3, Lot 2. Parking is prohibited along the entire front, south side of the building, from the curbline to the designated parking areas. Parking is also prohibited along either side access road, north and west sides of the facility.
(22) 
760 Route 70 West. Block 4, Lot 4.04. Parking is prohibited around the entire perimeter of the building, from the curb to the designated parking areas. Parking is also prohibited along either side of the access roads.

15 Stow Road. Block 2.06, Lot 3. Parking is prohibited from the street curb to the lot end and also along the side of the building, except designated parking areas.

525 Old Marlton Pike (Shopping Center). Block 22, Lot 2. Parking is prohibited on both sides of the access roads, each end of the shopping center from Old Marlton Pike to the designated parking areas and along the entire curbline on the south side of the front area. Parking is also prohibited on the east side out to the designated parking areas.
(26) 
Allison Shopping Center. Block 12, Lot 2, 29 North Maple Avenue. Parking is prohibited along the entire curbline of storefronts on the south side of the shopping center, from the handicap ramp westerly to the end of the building; along the entire curbline of the access road on the west end of the building, from driveway to driveway; along the rear of the building by the rear exits on the north side of the shopping center; and parking is also prohibited on both sides of the rear access road running north and south.

Parking is prohibited on both sides of the shopping center except for the designated loading and unloading zones and designated parking area. Parking is also prohibited along the east side of the front of the stores beginning at the designated parking area and continuing to the rear access road. Parking is prohibited at the Chesterbrook Academy along the curbside opposite the designated dropoff parking area. Parking is also prohibited along the east side of the stores beginning at the designated parking area and continuing to the rear access road.
(32) 
Marlton Greene Shopping Center, 36 West Route 70, as listed on the current Tax Map of the Township of Evesham as Block 25, Lot 2.03. Parking is prohibited along the entire frontage from the curbline out to the designated parking areas on the west side of the building. Parking is also prohibited on both sides of the rear access road to 10 feet from the fire hydrant.

Marlton Crossing Shopping Center, 101-251 Route 73 South, as listed on the current Tax Map of the Township of Evesham as Block 24.21, Lots 1 and 2. Parking is prohibited along the entire frontage of stores from the curbline out to the designated parking areas and on both sides of the circular drive.

Parking is prohibited along the entire perimeter of the building except designated parking areas. Parking is prohibited along all curb areas throughout the parking area except for designated parking areas. Parking is also prohibited on both access roads off Route 73 and Lincoln Drive West and the Fire Department connection.

Parking is prohibited on both sides of all access roads leading to the rear parking area. Parking is prohibited along the entire inside of the circular drive in front of the school.
(60) 
Evesham Municipal Complex, 984 Tuckerton Road, as listed on the current Tax Map of the Township of Evesham as Block 45, Lot 1. Parking is prohibited on both sides of the access road except for designated parking areas. Parking is also prohibited on both sides of the circular drive.
(61) 
DeMasi Middle School, 199 Evesboro-Medford Road, as listed on the current Tax Map of the Township of Evesham as Block 13.68, Lot 8. Parking is prohibited 10 feet on either side of the east and west emergency access roads. Parking is prohibited in front of the Fire Department connection, 40 feet long, 10 feet from the building. Parking is also prohibited along the inside of the circle of the east rear parking area.

Parking is prohibited along all curblines not designated parking areas, with the exception of all access roads leading into the complex and the two loading zones located on the east side of Buildings C and D.

Target Store, 751 Route 73 South, as listed on the current Tax Map of the Township of Evesham as Block 36, Lot 4.04. Parking is prohibited along both sides of all curblines around the entire perimeter of the building.

Cherokee High School North and South, as listed as Block 36, Lot 4.04. Parking is not permitted along the entire curbline of the north side of the building with the exception of handicap parking area. Parking shall be prohibited along the curb on the western property line adjacent to the north building. Parking shall be prohibited along the curbing on the east side of the south building.
(65) 
Marlton Elementary School, as listed as Block 39, Lot 1.01 partial, Lot 1.02. Parking is prohibited along the fire lane along the south and west sides of the building.
(66) 
Richard Rice Elementary School, as listed as Block 51, Lot 3. Parking shall be prohibited along the west side of the building.
(67) 
Parking is prohibited 10 feet either side of all fire hydrants in the Township of Evesham.
(68)

C. 
Unless another penalty is expressly provided for by New Jersey statutes, any person convicted of a violation of the provisions of this section shall be subject to a fine of $100 and, in addition thereto, the Police Department of the Township of Evesham shall have the authority to cause said vehicle found in violation to be towed and stored at the expense of the owner.
D. 
On all future commercial establishments, including apartments, the Planning Board shall require the applicant to submit a copy of the plans to the Division of Fire Prevention for review and recommendations regarding fire lanes. The Planning Board shall consider the advice of the Division of Fire Prevention when determining the placement of fire lanes at each such establishment. Final approval of the plans shall require that the applicant request adoption by the governing body of an ordinance designating the agreed-upon fire lanes.
E. 
The signs and painting designation required hereunder shall be provided by the owner of the respective establishments covered by this section at his or its expense and shall, in any event, be completed before the certificate of occupancy is issued. If not so completed, the Township may take the necessary steps to obtain compliance and bill the owner for the reasonable cost thereof.
F. 
The parking regulations applicable to said designated fire lanes shall be enforced by the Fire Official and staff or the Police Department of Evesham Township.

A. 
For the purposes of this section, an approved outdoor fire shall be classified as any fire taking place on a residential property within Evesham Township for the sole purpose of providing warmth, recreation, heating, cooking, and ceremonial use.
(1) 
Fuel for outdoor fires shall be limited to seasoned firewood, natural gas, or propane.
(2) 
Firepits shall not exceed three feet in diameter and two feet in height of total fuel.
(a) 
Firepits shall not be located within 25 feet of a structure, combustible materials, combustible vegetation, and property lines.
(b) 
Firepits may be deemed unsafe and ordered taken out of service by the Fire Official if they are overloaded with material, the weather conditions may promote fire growth, or, in the opinion of the Fire Official, continued use may lead to an increased fire hazard/risk.
(c) 
These devices shall not be utilized for rubbish or yard waste disposal purposes.
(3) 
Approved containers for a fire are defined as chimineas and/or other commercially manufactured containers designed and built for its specific use for seasoned firewood, natural gas, or propane.
(a) 
Approved containers shall not be located within 15 feet of a structure, combustible materials, combustible vegetation, and property lines.
(b) 
Approved containers or barbecues shall not be located in or on any residential/apartment unit: porch, balcony, covered patio area or any other private area of an apartment or multifamily dwelling unit.
(c) 
Fires in approved containers may be deemed unsafe and ordered taken out of service by the Fire Official if they are overloaded with material, the weather conditions may promote fire growth, or, in the opinion of the Fire Official, continued use may lead to an increased fire hazard/risk.
(d) 
These devices shall not be utilized for rubbish or yard waste disposal purposes.
B. 
Bonfires, outdoor fires, and campfires are prohibited in Evesham Township unless a fire permit has been issued by the Fire Official. Permitting by the New Jersey Forest Fire Service may also be necessary.
C. 
Outdoor fire enforcement:
(1) 
The Fire Official. Fire Inspectors, and Fire Chiefs of Evesham Township Fire District No. 1 are empowered to have any outdoor fire extinguished for the following reasons:
(a) 
A complaint is filed in regards to a smoke condition.
(b) 
Any unsafe condition is determined by the Fire Department.
(c) 
If New Jersey Forest Fire Service has determined drought conditions.
D. 
Violations and penalties. Any person who violates Subsection A, B, or C of this section shall be assessed a fine of $100 for the second and subsequent occurrence for unauthorized burning. The Bureau of Fire Prevention shall enforce the provisions of this section.

No person shall store or park or cause to store or park any internal combustion engine vehicle, including but not limited to those commonly known as "motorcycle," "moped," "go-cart," "dirt bike," "lawn mower," "snowblower," etc., in or on any apartment unit porch, balcony, covered patio area, entrance, exit or any other private area of an apartment or multi-dwelling unit.

All doorway entrances shall have printed thereon, in block letters at least three inches high, and approximately six inches from the top of the doorway, in conspicuously contrasting colors, the name of the commercial establishment located therein; provided, however, that there shall be exempt from this requirement such main entrance(s) as are otherwise conspicuously and clearly marked with the identity of the commercial establishment located therein. It is the intent of this provision that emergency personnel arriving at the scene of a fire or other emergency have immediate identification of access routes to commercial occupancies located in a particular commercial building or buildings.

A. 
Dumpsters, and trash compactors containing combustibles shall not be placed in buildings or within 15 feet from the exterior of a building wall, opening(s), or roof eave lines.
(1) 
Exception: areas protected by an approved automatic sprinkler system installed in accordance with NFPA 13.
