No person or persons, firm, association or corporation shall suffer or permit any fence, hedge, ornamental planting, bush or other plant or shrub to be erected or to grow on any corner property owned or occupied by him or them in the Village of Farmingdale, Nassau County, New York, formed by the intersection of two streets, roads or avenues, to a greater height than three feet above the street level on any portion of said property within a radius of 30 feet when measured from the corner of the property formed by the intersection of the curbline of the two streets.
The Board of Trustees may, upon application in a specific case, grant, upon conditions, a variance or exception where compliance with the provisions of the foregoing sections would cause unnecessary hardship to the owner or occupant of the land affected, without any compensatory benefit to the community, and where the granting of such variance or exception will not materially affect the hazard of traffic.
Any person or persons, firm, association or corporation violating any provision of this chapter or any part thereof shall be liable for and forfeit and pay a penalty not to exceed § 250 or 15 days' imprisonment, or both, every day during which such violation shall continue, and in addition thereto any violation of this chapter or any part thereof shall constitute disorderly conduct and any person violating the same or any part thereof shall be and is hereby declared a disorderly person.
In addition to the penalties prescribed in § 564-3, the Board of Trustees may cause a notice to be served upon any person or persons, firm, association or corporation violating the provisions of this chapter, to remove such violation within 10 days from the date of the mailing of such notice, and upon the failure of said person or persons, firm, association or corporation to remove said violation within said 10 days, then the Board of Trustees of the Village of Farmingdale may cause such violation to be removed and the total cost thereof shall be assessed upon the real property upon which such fence, hedge, ornamental planting, bush or other plant or shrub violating the provisions of this chapter is found, and shall constitute a lien and charge on the real property on which it is levied until paid or otherwise satisfied or discharged, and shall be collected by the Village Clerk-Treasurer in the manner provided by law for the sale of delinquent taxes.
This chapter shall take effect November 1, 1953.
