[Adopted 5-11-1936 by Ord. No. 52 (Ch. 103, Art. I, of the 1975 Code)]
No person or persons, firm, partnership, association, company or corporation of whatsoever nature shall construct, maintain or install, or permit to be constructed, maintained or installed, any cesspool, sewage disposal works or other source of pollution within 200 feet of any Village water well which is now used or may at any time in the future be used for the purpose of supplying water to the inhabitants of the Village of Farmingdale. The Board of Trustees of the Village or its duly authorized representatives shall be the sole judges of what constitutes sources of pollution in violation of this article.
Any and every person who shall violate any of the provisions of this article or who shall fail to comply therewith shall be subject to a fine not to exceed $250 or 15 days' imprisonment, or both, and shall forthwith, upon oral or written notice of any employee or official of the Village of Farmingdale, proceed to correct and remedy such violation without any delay. If such person or persons who shall violate any of the provisions of this article, after notice of such violation in the matter above set out, does not forthwith proceed to correct and remedy such violation, then he shall be subject to an additional fine of $50 for each additional day that said violation continues.

The conduct of any person or persons violating any of the provisions of this article shall constitute disorderly conduct, and any person violating the same shall be and is hereby declared a disorderly person.
