A. 
All officers, employees or appointees to any board employed by the Borough of Edgewater, other than those having a statutory exemption, are hereby required as a condition of their being initially hired or appointed, to have their place of abode in the Borough of Edgewater and to have a bona fide residence therein. Any statutory requirement governing members of any body which mandates residency shall not be deemed affected by this section.

B. 
A "bona fide resident," for the purpose of this article, is a person having a permanent domicile within the Borough of Edgewater and one which has not been adopted with the intention of again taking up or acquiring a previous residence outside of the Borough of Edgewater.
C. 
Excluded from the operation and effect of this article are all those employees that had been hired and were working for the Borough of Edgewater prior to the passage of Ord. No. 560-74.[1]

D. 
Notwithstanding the provisions of Subsection A of this section, the Mayor and Council may appoint an officer or employee who is not a bona fide resident of the Borough of Edgewater when:

(1) 
In the sole and exclusive discretion of the governing body, the qualifications of such appointee are deemed to be superior to other candidates;
(2) 
When such person is deemed to be the most suitable candidate for the position.
The Mayor and Council of the Borough of Edgewater, or a duly appointed agent, is hereby authorized to investigate into the residency of any officer, employee or appointee to any board and to require the officer, employee or appointee to any board to produce proof of bona fide residence.
The officer, employee or appointee to any board shall be given a ten-day notice setting forth the charge that he is not a bona fide resident of the Borough of Edgewater. The notice shall also set forth the time and place of hearing to be held by the Mayor and Council, and the officer, employee or appointee to any board shall be entitled to a full hearing.
Failure of any officer, employee or appointee to any board of the Borough of Edgewater, other than those who have a statutory exemption, to appear at the time and place of the hearing set forth in the notice or to comply with the residence requirements shall be sufficient cause for his removal or discharge from his service of the Borough of Edgewater.
