The Board of Trustees of the Village of East Hills determines
that, to protect the public health, safety and welfare of the residents
of the Village of East Hills, the public interest requires the licensure
of companies engaged in providing snow removal services operating
within the Village so that their activities can be properly controlled
and regulated within the Village.
As used in this chapter, the following words and phrases shall
have the following meanings:
Includes any person who is engaged in providing products
and services as a for-profit business.
Includes any person or business entity which engages in the
removal of snow from any property located in the Village of East Hills.
Includes any individual, association of individuals, firm,
partnership in any form or corporation in any form.
No person who is engaged in providing snow removal services
and who operates a business for profit shall conduct snow removal
services at any location, property or address within the Village,
whether commercial or residential, without having first obtained a
license from the Village Clerk. The person must also agree to conform
to the provisions of this chapter with respect to the conduct required
of companies engaged in providing snow removal services; except, however,
that no license shall be required from any person engaged under contract
by the Village for the purpose of removing any materials, products,
substances, items or waste as part of an overall contract with the
Village to conduct this business.
A.
All companies engaged in snow removal services shall apply to the
Village Clerk for the license and pay therefor a fee as set forth
from time to time by resolution of the Board of Trustees.
B.
The applicant shall complete a written application for a license
which shall be filed with the Village Clerk and shall specify the
following:

Each license issued under this section shall be issued as of the
date of the granting of the license and shall expire on May 31 of
the year next succeeding such date unless sooner suspended or revoked.
In addition to any other conduct prohibited under the Code of
the Incorporated Village of East Hills, it is a violation to fail
to replace, within four weeks of damage by a company engaged in snow
removal services, any property damaged, destroyed or removed, whether
belgium blocks, driveways, roads, trees, or other property of any
kind located in the Village.
A.
Any license issued pursuant to this chapter shall not be assignable
or transferable.
B.
Any license issued pursuant to this chapter, or a copy, shall be
conspicuously affixed to each commercial vehicle or truck used in
providing these services and shall not be removed from the motor vehicle.
C.
Upon the filing of an affidavit or such other proof as may be required
by the Village Clerk, a substitute or replacement license may be issued
upon the payment of a fee as set forth from time to time by resolution
of the Board of Trustees.
A violation of this chapter shall, upon conviction, be punishable
by $500 for the first offense and $1,000 for each subsequent violation.
Each day that a violation of this chapter shall continue shall constitute
a separate offense. Furthermore, the Village retains its election,
through any decision which is not arbitrary and capricious, to suspend
or terminate and refuse to reissue any license for any time it deems
appropriate for any person who violates the Code of the Incorporated
Village of East Hills.
