As used in this Part, the term "Firearm" shall include shotgun, air gun, air pistol, spring gun or pistol, rifles and pistols of any caliber, or any implement which implies a pellet of any kind with sufficient force capable of causing property damage or bodily harm.

Nothing herein contained shall prohibit the use of any firearm by any person who is properly licensed by the Pennsylvania Game Commission and who is acting in compliance with the Pennsylvania Game and Wildlife Code during the official Pennsylvania game season, or the use of any firearm on an approved target range, as provided in § 203, hereof, or the use of any firearm by any person licensed to carry and use a firearm for law enforcement purposes.

It shall be permissible to use and otherwise to discharge a firearm under the following conditions and circumstances in an Agricultural (A-1) District or a Conservation (C-1) District of Kingston Township as follows:
1. 
The use of a firearm in a zoning district designated as "Agricultural" or "Conservation" during any official Pennsylvania game season, provided that said firearm is not discharged within 200 yards of any building or structure, and that said firearm is used in accordance with the game laws of the Commonwealth of Pennsylvania; and
2. 
The use of any type of firearm on a target range, as approved by the Board of Supervisors of Kingston Township and for which a special permit has been issued by the Manager of Kingston Township, in a zoning district designated as "Agricultural" or "Conservation" by the Kingston Township Zoning Ordinance (i) while under adult supervision, and (ii) only for target shooting, and (iii) only during the hours from noon until dusk; and
3. 
The use of firearms by any person or persons licensed to carry and to discharge such firearms for law enforcement purposes.

Any police officer of the Township of Kingston, lawfully engaged in his law enforcement duties within the Township of Kingston, is hereby authorized to seize any firearm, as defined herein, which shall be fired or discharged or used generally in violation of this Part. Upon such seizure, the Police Department of the Township shall issue to the owner of the firearm a written receipt stating the make, model, caliber and serial number of said firearm. The firearm shall be held by the Police Department of the Township of Kingston, and it shall be disposed of in the manner ordered by any court in any proceeding brought before the court under § 205 hereof.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.

If any sentence, clause, section, or part of this Part is for any reason found to be unconstitutional, illegal, or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this Ordinance. It is hereby declared as the intent of the Township of Kingston that this Part would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.
