This Part shall be known and may be cited as "Alcohol Consumption
Ordinance" of the Township of Kingston.

The following words when used in this Part shall have the meaning
ascribed to them in this Section, except in those instances where
the context clearly indicates a different meaning.

No person shall be permitted to consume alcohol from any bottle,
glass, can, cup or other container upon any of the streets, alleys
roads, parks, public grounds, public places or public vacant lots
in the Township of Kingston.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a district justice in the manner provided for the enforcement of summary
offenses under the Pennsylvania Rules of Criminal Procedure, shall
be sentenced to pay a fine of not more than $1,000 plus costs and,
in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each Section of this Part which shall be found to have been violated
shall constitute a separate offense.

The provisions of this Part are severable. If any sentence,
clause or section of this Part is for any reason to be unconstitutional,
illegal, or invalid, such unconstitutionality, illegality or invalidity
shall not affect or impair any of the remaining provisions, sentences,
clauses or sections of this Part. It is hereby declared to be the
intent of the Board of Supervisors of the Township of Kingston that
this Part would have been adopted had such unconstitutional, illegal,
or invalid sentence, clause or section not be included herein.
