The Board of Supervisors shall provide, by resolution adopted from time to time, for the recognition and designation of a primary provider of emergency medical services (EMS) and rescue services for the Township of Kingston, all consistent with the relevant provisions of the Pennsylvania Emergency Services Act, 35 P.S. § 6921 et seq., as the same may be amended from time to time, and all case law thereunder.

The Shavertown Volunteer Fire Department and the Trucksville Volunteer Fire Department, nonprofit corporations organized and existing under the laws of the Commonwealth of Pennsylvania, with the principal place of business of the Shavertown Volunteer Fire Department at 170 North Main Street, Shavertown, Kingston Township, Pennsylvania 18708, and the principal place of business of the Trucksville Volunteer Fire Department at 11 Carverton Road, Trucksville, Kingston Township, Pennsylvania 18708, are hereby recognized and designated as the primary providers of fire protection for Kingston Township.

The Board of Supervisors shall provide, by resolution adopted from time to time, for the designation of a primary provider of emergency medical services for the Township of Kingston, which shall act as the first-due EMS responder for all emergencies requiring basic life support care, treatment or transportation in the Township of Kingston. Further, in like manner, by resolution adopted from time to time, the Board of Supervisors shall provide for the designation of a first-due EMS responder for all emergencies requiring advanced life support (ALS) care, treatment or transportation in the Township of Kingston. Further, the Board of Supervisors shall direct the Luzerne County Communications Center to dispatch such designated ambulance service and designated paramedic service as the first-due provider for all emergencies arising within the limits of the Township of Kingston. In addition, in such resolution, the Board of Supervisors shall provide for one or more designation(s) of ambulance service(s) and paramedic service(s) as substitute emergency service provider(s) in the event that the designated emergency first-due responders are unavailable for service for any reason. The designation of such substitute emergency providers, together with all services to be provided by them, shall be stated in a written agreement between the Township of Kingston and the substitute emergency provider(s). In the absence of such designated substitute emergency provider(s), the next-closest basic life support (BLS) and/or advanced life support (ALS) emergency provider(s) shall be dispatched.

The Shavertown Volunteer Fire Department and the Truckville Volunteer Fire Department, as the primary providers of fire service for all fire emergencies, shall be the first-due fire service providers in their respective service areas for fire emergencies. The Board of Supervisors directs the Luzerne County Communications Center to dispatch these fire departments as the first-due provider for all emergencies requiring the fire service within the Township limits. In the event that Shavertown and Trucksville Volunteer Fire Departments are unavailable for any reason, the next closest available fire department should be dispatched, or any such second or third-due provider as the fire departments may designate, or any fire department with which Shavertown or Truckville Fire Department may have a mutual aid agreement in place.
