For the purpose of these regulations, certain words and terms used herein are defined as follows:
BLOCK
An area bounded by public rights-of-way.
CLEAR SIGHT TRIANGLE
An area of unobstructed vision at street intersections defined by lines of sight between points at a given distance from the intersection of street right-of-way lines.
BUILDING OFFICIAL
The person designated by the Town Board to perform all administrative and/or supervisory duties required by these regulations.
COLLECTOR STREET, MARGINAL ACCESS OR APPROACH STREET
A street which serves or is designed to serve as a traffic way for a neighborhood or as a feeder to a major street.
DEAD-END STREET OR CUL-DE-SAC
A street or portion of a street with only one vehicular traffic outlet.
DEDICATION
The deliberate assignment of land by its owner for any general and public uses, reserving to himself no other rights than such as are compatible with the full exercise and enjoyment of the public uses to which the property has been devoted.
EASEMENT
Authorization by a property owner for the use by another, and for a specified purpose, of any designated part of his property.
ENGINEER or LICENSED PROFESSIONAL ENGINEER
A person licensed as a professional engineer by the State of New York.
INTERIOR WALK
A right-of-way for pedestrian use extending from a street into a block or across a block to another street.
LARGE-SCALE OR CLUSTER DEVELOPMENT
A plot of land, 20 or more acres in size, designated to be subdivided under the provisions of these regulations by the utilization of the density control method, whereby actual lot dimensions and area may be waived in accordance with Chapter 265, Zoning, of the Code of the Town of Kendall.
LOT
A tract or parcel of land intended for transfer of ownership use or improvement.
MAJOR STREET
A street which serves or is designed to serve heavy flows of traffic and which is used primarily as a route for traffic between communities and/or other heavy-traffic-generating areas.
MAJOR SUBDIVISION
Any subdivision not classified as a minor subdivision, including, but not limited to, subdivisions of five or more lots, or any size subdivision requiring any new street or extension of municipal facilities.
MASTER OR COMPREHENSIVE PLAN
A comprehensive plan, prepared by the Planning Board pursuant to § 272-a of the Town Law which indicates the general locations recommended for various functional classes of public works, places and structures and for general physical development of the Town and includes any unit or part of such plan separately prepared and any amendment to such plan or parts therein.
MINOR STREET
A street intended to serve primarily as an access to abutting properties.
MINOR SUBDIVISION
Any subdivision containing not more than four lots fronting on an existing street or road or the extension of municipal facilities and not adversely affecting the development of the remainder of the parcel or adjoining property and not in conflict with any provision or portion of the Master Plan, Official Map, or Chapter 265, Zoning, or this chapter.[1]
OFFICIAL MAP
The map established by the Town Board pursuant to § 270 of the Town Law, showing streets, highways, and parks, and drainage, both existing and proposed.
PARTIAL STREET, ALLEY
A minor right-of-way providing vehicular access to the side or rear of two or more properties, and only serving as a secondary means of access to two or more properties.
PLANNING BOARD or BOARD
The Planning Board of the Town of Kendall.
PRELIMINARY PLAT
A drawing or drawings clearly marked "preliminary plat" showing the salient features of a proposed subdivision, as specified in Article VI, § 210-26, of this chapter, submitted to the Planning Board for purposes of consideration prior to submission of the plat in final form and of sufficient detail to apprise the Planning Board of the layout of the proposed subdivision.
REVERSE FRONTAGE LOT
A lot extending between and having frontage on a major traffic street and a minor street, and with vehicular access solely from the latter.
RIGHT-OF-WAY
Land reserved for use as a street, alley, interior walk, or for other public purpose.
SIGHT DISTANCE
The maximum extent of unobstructed vision (in a horizontal or vertical plane) along a street from a vehicle located at any given point on the street.
SKETCH PLAN
A sketch of a proposed subdivision showing the information specified in Article VI, § 210-25, of this chapter to enable the subdivider to save time and expense in reaching general agreement with the Planning Board as to the form of the layout and objectives of these regulations.
STREET
Means and includes street, roads, avenues lanes, or other traffic ways, between right-of-way lines.
STREET PAVEMENT
The wearing or exposed surface of the roadway used by vehicular traffic.
STREET WIDTH
The width of right-of-way, measured at right angles to the center line of the street.
STREET, PUBLIC
A street dedicated to public use.
SUBDIVIDER
Any person, firm, corporation, partnership or association, who shall lay out any subdivision or part thereof as defined herein, either for himself or others.
SUBDIVISION
The division of any parcel of land into two or more portions or parcels or other division for immediate or future sales or for building development with or without streets or highways. Minor adjustments in existing property lines shall not be considered a subdivision. Resubdivision is included as a subdivision.
SUBDIVISION PLAT or FINAL PLAT
A drawing, in final form, showing a proposed subdivision containing all information or detail required by law and by these regulations to be presented to the Planning Board for approval, and which if approved, may be duly filed or recorded by the applicant in the office of the County Clerk or Register.
SURVEYOR
A person licensed as a land surveyor by the State of New York.
TOWN BOARD
The Town Board of the Town of Kendall.
TOWN ENGINEER
The duly designated engineer by the Town.
ZONING BOARD
The Zoning Board of the Town of Kendall.
