There is hereby created a Recreation Board known as the "Recreation Board of the Borough of Walnutport."
A. 
The Recreation Board shall be composed of seven members, to be appointed by Borough Council, with the power to provide and conduct recreation and cultural activities and maintain public recreation areas, facilities, and centers subject to all the responsibilities of the Borough Code. The Board Members shall serve staggered terms with four members serving a term of four years and three members shall serve for a term of three years or until their successors are appointed by Borough Council, except that the members first appointed shall be so appointed such that the term of one member shall expire annually thereafter. Vacancies shall be filled in the same manner as original appointments and for the unexpired term. Members shall serve without pay.
B. 
With respect to the initial term for members of the Board, in order to comply with the Borough Code such that at least one member's term expires annually, the initial Board members term for three-year members shall be one, two and three years, respectively. The initial term of the four-year members shall be one, two, three and four years, respectively.
C. 
The Borough Council reserves the right to modify the number of members of the Board and to shorten or otherwise modify the length of the term of any member at any time hereafter.
D. 
All Board members must be residents of the Borough of Walnutport.
E. 
Any member of the Recreation Board once qualified and appointed may be removed from office for malfeasance, misfeasance or nonfeasance in office or for just cause by a majority vote of the Borough Council, after such member has received 15 days' advance notice of the intent to take such a vote. A hearing shall be held in connection with the vote if the member shall request it in writing.
The Recreation Board shall appoint from its membership a chairman and secretary and such other officers as it may deem necessary for the orderly procedure of its business, and may adopt bylaws, rules, and regulations covering its procedure not inconsistent with the provisions of the Borough Code. The Recreation Board shall, from time to time, make rules governing the operation and conduct of the recreational facilities operated by the Board. The Board shall hold regular meetings at such time and place as it may designate. In addition, the Recreation Board shall operate and conduct business in accordance with the Borough Code.
The Recreation Board may help operate and supervise the public parks, playfields, and all outdoor and indoor recreation areas and facilities owned or controlled by the Borough of Walnutport. The Recreation Board, as such Board shall hereafter be called, is specifically given the authority to equip, operate, supervise and maintain recreation places within or without the Borough as may be owned by the Borough or as may hereinafter be owned by the Borough and any other municipality, providing that such other municipality consents to such jurisdiction of the Recreation Board.
The Recreation Board may accept any grant, gift, bequest, or donation of services, equipment, real estate, or money from any individual or group, to be used as specified by the donor, or by the terms of acceptance. The Recreation Board shall have no authority to enter into any contract or incur any obligation without the Council of the Borough of Walnutport's consent.
Funds appropriated by the governing body of the Borough of Walnutport, and budgeted to the Recreation Board, shall be disbursed by the secretary of the Borough of Walnutport. Funds received by the Recreation Board from sources other than budget appropriations, including but not limited to any and all grants, shall be deposited by the Borough of Walnutport, to the credit and for the use of the said Board on behalf of the Borough and disbursed as the above budget funds are disbursed, except that funds received and/or retained by or on behalf of the Recreation Board by gift, bequest, or otherwise shall be disbursed in accordance with the terms of the acceptance thereof and with the consent of Borough Council.
The Recreation Board shall submit quarterly reports and such other reports as needed to the governing body at such times as may be designated or requested by the governing body. The fiscal year of said Recreation Board shall conform to that of the Borough of Walnutport.
Such powers that are now or may hereafter be provided by statute of the Commonwealth of Pennsylvania, or by ordinances of the Borough of Walnutport relating to the development and operation of recreation systems, public parks, and playgrounds, are hereby vested in the Recreation Board, to be exercised by it, subject to any and all restrictions contained in such powers and ordinances and subject to final approval by the Borough of Walnutport before any action shall be taken by the Recreation Board.
