Article I Defined Contribution Retirement Program

[Adopted 2-11-2010 by Ord. No. 2010-1]

§ 65-1 Positions eligible for participation.

Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program if and when the position is filled by a qualified and eligible individual:

A. Borough Administrator;

B. The following department heads (unless exempted as set forth below):

(1) Department head of the Department of Land Use and Zoning;

(2) Department head of the Department of Finance;

(3) Department head of the Department of Construction and Building; and

(4) Department head of the Department of Public Works.

C. Borough Engineer;

D. Director of Public Safety;

E. Municipal Prosecutor;

F. Municipal Public Defender; and

G. Municipal Court Judge.

§ 65-2 Positions exempt from membership.

Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:

A. Certified Health Officer;

B. Tax Collector;

C. Chief Financial Officer;

D. Construction Code Official;

E. Qualified Purchasing Agent;

F. Tax Assessor;

G. Municipal Planner;

H. Registered Municipal Clerk;

I. Licensed Uniform Subcode Inspector; and

J. Principal Public Works Manager.

§ 65-3 Implementation and construal.

This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.) as amended from time to time, and any regulations or guidelines provided by the Local Finance Board or the Division of Pensions and Benefits.
