[Adopted 6-9-2010 by L.L. No. 8-2010]
This article shall be known as "Local Law No. 8 of the Year
2010, Residency Requirements for Public Officers of the Village of
Wappingers Falls."
This article is established to allow certain public officials
of the Village of Wappingers Falls to reside outside of said Village
pursuant to § 3-300(2)(a) of the Village Law of the State
of New York.
A.
Provisions of § 3-300(2)(a) of the Village Law of the State
of New York or any other provision of law requiring the person to
be a resident of the political subdivision or municipal corporation
of the state for which he or she shall be chosen and in which his
or her official functions are required to be exercised cannot prevent
the following Village officers from holding said office, if such person
resides in the County of Dutchess where the Village of Wappingers
Falls is located.
C.
Nothing contained here shall have any effect on previous appointments
made by the Mayor and Village Board of the Village of Wappingers Falls,
as each appointment was made with the specific knowledge of the residence
of the appointee and with a clear waiver of any requirement pursuant
to § 3-300(2)(a) of the Village Law of the State of New
York.
