A. 
The City of Española created the Española Veterans' Memorial with federal, state and local funds.
B. 
The Española Veterans' Memorial honors those men and women who honorably served our nation in all the wars and conflicts that this nation has endured to preserve our freedom, liberty, and democratic way of life.
C. 
The City takes great honor in establishing this chapter, thereby laying the cornerstone for the Española Veterans' Memorial Foundation to perpetuate the Española Veterans' Memorial. In so doing, the City honors its unselfish veterans who heroically served their country and ensured our freedoms and our American way of life.
The governing body of the City of Española hereby creates the Española Veterans Memorial Foundation; and the initial Board of five members shall be appointed by the Mayor and ratified by the City Council.
The Española Veterans Memorial Foundation has the responsibility to:
A. 
Perpetuate itself with its bylaws; and
B. 
Create and fiscally manage an endowment for the purpose of maintaining, expanding, and preserving this Memorial to recognize honorably discharged veterans of our northern New Mexico communities.
The City of Española shall:
A. 
Make available the property for the Española Veterans Memorial at no cost to the Española Veterans Memorial Foundation.
B. 
Assume all liability for the property and facilities belonging to the City of Española.
C. 
Assume the responsibility to maintain, expand and preserve the Española Veterans Memorial in the event that the Foundation is unable to do so.
