Borough of Westwood, NJ Fees

For retail food handling establishments, including liquor stores, delicatessen stores, meat markets (whether or not the establishments are also the manufacturers), and mercantile licenses: a fee of $125 annually.

For restaurants, including luncheonettes, diners, taverns, pizza kitchens, etc., payment shall be in accordance with the following schedule:

(1)

Establishments seating 1 to 99 persons: $170 annually.

(2)

Establishments seating 100 persons or more: $230 annually.

For bakeries: a fee of $160 annually.

For food caterers: a fee of $160 annually.

For vending machines dispensing any food: a fee of $50 for the first machine and $25 for each additional machine, owned by the same licensee, annually.

For vending trucks dispensing any food: a fee of $95 for each truck annually.

For confectionery stores dealing in packaged candy, ice cream and similar products: a fee of $100 annually.

For proprietary nursing homes: a fee of $400 annually.

For nursery schools: a fee of $200 annually.

For pet shops: a fee of $125 annually.

For public swimming pools, including whirlpools, payment shall be in accordance with the following schedule:

(1)

Seasonal swimming pool: a fee of $200 annually.

(2)

Year-round swimming pool: a fee of $380 annually.

For supermarkets, a self-service retail establishment with the total area being measured from wall to wall in the interior measuring over 5,000 square feet: a fee of $525 annually.

For temporary retail food licenses for special events:

(1)

A one-day event: a fee of $50.

(2)

Two-day event: a fee of $60.

(3)

A three-day event: a fee of $70.

(4)

A four- to seven-day event: a fee of $100.

For temporary retail food licenses for special events taking place once per week occurring on consecutive weeks:

(1)

Twelve consecutive weeks, once per week: a fee of $150.

(2)

Thirteen to 24 consecutive weeks, once per week: a fee of $200.

(3)

Twenty-five to 36 consecutive weeks, once per week: a fee of $300.

For the issuance of a burial permit: the statutory fee of $5.

For the issuance of a certified transcript of a vital record for any marriage, civil union, domestic partnership, birth or death: a fee of $25 per transcript; each additional transcript issued at the same time to the same person for the same record: a fee of $2 each.

For the issuance of a marriage license: a fee of $28.

For the issuance of a domestic partnership: a fee of $28.

For the processing and filing of an amendment to vital record(s) (birth, marriage, civil union, domestic partnership, or death): a fee of $50.

For tanning salons: a fee of $200 annually.

For permanent cosmetics, including but not limited to microblading and camouflage: a fee of $200 annually.

§ 387-2 Issuance of licenses; renewals; late charges; additional fees; furnishing of information.

All licenses shall be issued before the calendar year commencing January 1 and shall be obtained or renewed not later than January 15 in any calendar year.

A late charge of 50% will be added to the license fee if not renewed by February 15 of that same year.

When a licensee requires the issuance of an interim, conditional or temporary license, the Board of Health shall be entitled to charge a processing fee of $100 for each such issuance.

When a licensee requires additional inspections due to a conditionally satisfactory Chapter 24 inspection rating, payment shall be in accordance with the following schedule:

(1)

First reinspection: a fee of $50.

(2)

Second reinspection: a fee of $100.

(3)

Three or more reinspections: a fee of $150 per inspection.

When a licensee requires additional inspections due to a unsatisfactory Chapter 24 inspection rating, payment shall be in accordance with the following schedule:

(1)

First reinspection: a fee of $200.

(2)

Second reinspection: a fee of $300.

(3)

Three or more reinspections: a fee of $400 per inspection.

Applicants for licenses or permits shall furnish any and all information required by the Board. Any false or misleading information shall constitute sufficient cause to refuse to issue a license or for revocation of a license already issued.

§ 387-3 Conducting business without a license or permit.

Conducting any business or performing any work which shall require a license or permit without first obtaining such license or permit shall constitute a violation of this chapter. A single transaction shall constitute "doing business" hereunder.

§ 387-4 Violations and penalties.

Any person, firm or corporation violating or failing to comply with any of the provisions of this chapter shall be liable for a penalty of not less than $25 nor more than $500 for each offense.

§ 387-5 Repealer.

The provisions of any ordinance or any part of any ordinance inconsistent herewith are hereby expressly repealed as to such inconsistency. In addition, the following ordinances or sections of ordinances are hereby expressly repealed:

An ordinance entitled, "An Ordinance Establishing Certain Fees to be Charged By The Board of Health of The Borough of Westwood," passed August 11, 2004.

§ 387-6 Waiver or reduction of fees.

The Board may, subject to law, waive or reduce the license fee or permit fee herein established in any particular case or class of cases where the imposition of said fee would work a hardship or injustice considering the costs of administration, regulation and inspection.
