A. 
Findings. Rochester Township finds that:
(1) 
Charlotte Avenue, between Walnut Street and Elm Street, is a residential area of Rochester Township and is unduly congested by the movement and parking of nonresident vehicles.
(2) 
Such congestion has had an adverse impact upon the residential character of Charlotte Avenue and poses a threat to the health, safety, and welfare of the residents along Charlotte Avenue.
(3) 
Such congestion substantially inconveniences the local residents by depriving them of the opportunity to park their vehicles near their homes.
B. 
Purposes. The Township Commissioners therefore have determined that the following benefits to the Township are achieved by the establishment of permit parking only on both sides of Charlotte Avenue:
(1) 
Preserve the residential character of Charlotte Avenue.
(2) 
Protect the health and safety of local residents by minimizing vehicular traffic along Charlotte Avenue and thereby reduce danger to children and other pedestrians.
(3) 
Conserve the value of property along Charlotte Avenue.
(4) 
Permit the convenience, comfort, and general welfare of residents of this Township.
As used in this article, the following words and phrases shall have the meanings specified:
MOTOR VEHICLE
An automobile, van, truck, jeep, utility vehicle, or motorcycle.
NONRESIDENT VEHICLES
A motor vehicle parked along Charlotte Avenue belonging to a person who is not a resident of the Township.
RESIDENT
An individual who owns or leases real property abutting Charlotte Avenue, or who is a bona fide resident of such avenue as either a member of a resident's household or otherwise.
A. 
The following avenue is designated for parking by valid permit only:
(1) 
Both sides of Charlotte Avenue between Walnut Street and Elm Street.
(2) 
Signs shall be erected by Rochester Township along said avenue indicating the location where parking shall be permitted only.
B. 
Permit required. The parking of motor vehicles on the streets designated above shall be limited at all times and dates to only those vehicles which display a valid residential parking permit.
A. 
Any person desiring to obtain a residential parking permit shall submit a written application to the Chief of Police on a form prescribed for that purpose. Each application shall be accompanied by a permit fee to be set by resolution of the Rochester Township Board of Commissioners. This fee shall be for the use of Rochester Township to be applied to the cost of administering the residential permit parking program. Such application shall set forth the applicant's name, residence address and driver's license number, and the make, model and registration plate number of the subject vehicle. Upon request, the applicant shall present for inspection his or her driver's license, and the vehicle's registration card. The Chief of Police may require other information relevant to the application within the Chief's discretion.
B. 
A separate application shall be required for each vehicle.
C. 
A local resident may apply for a permit to authorize parking by visitors of such resident. No more than one visitor permit may be issued to any one dwelling unit within the residential area. The application for a visitor permit shall state the reason(s) why the permit is being requested. Visitor permits may be shared between neighbors who reside on the designated street.
A. 
Upon the payment of the permit fee and finding that the applicant is entitled to a residential parking permit, the Chief of Police shall issue it. The permit shall show the registration number of the motor vehicle, the name and address of the holder, and the expiration date. All permits shall automatically expire on December 31. Permits shall be renewable annually before the expiration date upon making the application for renewal.
B. 
Upon finding that the reason(s) presented for a visitor permit establish good cause, the Chief of Police shall issue it. Such a permit may be limited in its duration, according to the circumstances shown.
A. 
The holder of a residential parking permit for Charlotte Avenue shall be permitted to use said permit only for parking on Charlotte Avenue. Said permit does not entitle the holder of a parking permit for Charlotte Avenue to use said permit to park on any other Township street/avenue designated as residential permit parking only. While a vehicle for which a residential parking permit has been issued is so parked, that permit shall be displayed so as to be clearly visible through the windshield of the vehicle.
B. 
A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.
C. 
A residential parking permit shall not authorize its holder to park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles; nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than those specified in the article.
D. 
The holder of a permit who ceases to be a resident in a designated parking area shall so notify the Chief of Police and shall surrender his or her parking permit.
The Chief of Police shall have authority to revoke the parking permit of any permit holder found to be in violation of any provision of this article. Upon written notification to him or her of the revocation, the permit holder shall surrender the permit to the Chief of Police.
A. 
It is unlawful to park a motor vehicle on a street designated in § 154-33 of this article at any time on any date unless a valid residential parking permit is displayed in such vehicle.
B. 
It is unlawful to display a residential parking permit in a vehicle other than that for which such permit was issued.
C. 
It is unlawful to furnish false information in connection with an application for a residential parking permit.
D. 
It is unlawful to make or to display a counterfeit residential parking permit.
A. 
Any person who violates any provision of this article shall, upon conviction, be sentenced to pay a fine of $25, together with any costs of prosecution.
B. 
Any vehicle which is parked in violation of this article shall be subject to being towed at the owner's expense.
This article may be enforced by officers of the Rochester Township Police Department.
This article is enacted pursuant to the provisions of the First Class Township Code.
