The Department of Public Works (DPW) is hereby established in the Borough of Westwood.

The Department of Public Works of the Borough of Westwood as herein established shall be under the overall control and supervision of the Mayor and Council of the Borough of Westwood. This control and supervision may, from time to time, be delegated to the Administrator of the Borough of Westwood or to one or more members of the Governing Body serving as a subcommittee for the purposes of monitoring the activities of the Department of Public Works.

A. 
The Mayor, with the consent of the Council, shall appoint a Superintendent of the Department of Public Works, to be designated as such by resolution.
B. 
The Mayor, with the consent of the Council, shall appoint a Foreman from the membership of the DPW to serve as Foreman for an additional stipend and/or hourly increase to be fixed annually by ordinance. The Foreman shall receive all economic benefits in effect for the position that said person occupied prior to appointment as Foreman and the additional compensation fixed for the Foreman duties. The Borough shall grant any person appointed as Foreman a leave of absence from the position vacated to assume the Foreman position, and said person shall be entitled (subject to any restrictions arising out of any collective bargaining agreement covering the DPW) to return to said position on the conclusion of the Foreman employment, if otherwise still qualified to hold that position.
C. 
The Mayor, with the consent of the Council, shall appoint an Assistant Foreman from the membership of the DPW to serve as Assistant Foreman for an additional stipend and/or hourly increase to be fixed annually by ordinance.
D. 
The Superintendent shall have the responsibility for the day-to-day functioning of the Department and for the general planning and supervision of the Department for the purposes of carrying out the policies, goals and directives of the Mayor and Council. The Superintendent's duties may be as more particularly described in a job description adopted from time to time.
E. 
It shall be the duty of the Foreman to assist the Superintendent and to serve as Deputy Superintendent in the absence of said individual. The duties of the Foreman may be more particularly described in a job description adopted and amended from time to time by the Mayor and Council.
F. 
It shall be the duty of the Assistant Foreman to assist the Superintendent and Foreman in their duties and to serve as Deputy Superintendent or Deputy Foreman in the absence of said individuals from work for one or more days. The duties of the Assistant Foreman may be more particularly described in a job description adopted and amended from time to time by the Mayor and Council.
G. 
It is intended that the Superintendent, Foreman and Assistant Foreman shall serve as the on-site end of the chain of command from the Mayor and Council and its designees to the employees of the Department. In consideration of the duties and responsibilities for the positions herein provided, the Superintendent, Foreman and Assistant Foreman shall be paid the salary established annually in the Borough Salary Ordinance.[1]

The duties of said Department of Public Works, by way of clarification and not by way of limitation, shall be such as laid down and required by the Mayor and Council through the Borough Administrator, which said duties shall include:
A. 
Maintenance of streets and roads;
B. 
Maintenance of lawns and grounds of public parks, municipal buildings and other municipal properties, including playgrounds;
C. 
Cleaning of streets;
D. 
Protection and cleaning of roads during the winter season, including spreading of sand, cinders and salt, as required;
E. 
Snow removal from public highways and walkways of all municipal properties;
F. 
Collection of garbage, refuse and recycling;
G. 
Painting of traffic lanes, markers, curb restrictions and other requirements for traffic control markings and maintenance of same;
H. 
Maintenance and erection of street signs and traffic signs as required and necessary;
I. 
Maintenance of all equipment as required by the Department; and
J. 
Maintenance of the Borough garage and sanitary landfills in an orderly and neat condition.

Any employee member of the Department of Public Works shall be subject to reprimands, deductions of pay, suspension from work, reduction in grade or dismissal, according to the nature or grievousness of his offense, for violating regulations, orders or resolutions, or for any violation of the rules and regulations of the Department of Public Works as outlined in the current bargaining agreement.

The Administrator shall, upon the final passage of this chapter, and with the advice of the Mayor and Council, publish a set of rules governing the work and conduct of the Department, which said rules shall be adhered to strictly by all members of the Department of Public Works. Said rules may be amended by the Administrator from time to time as the work and operation of the Department may require. A copy of said rules and regulations shall be posted in a conspicuous place in the Department headquarters, and it shall be the duty of all members of the Department to familiarize themselves with same.

The Mayor and Council and the Administrator may require the performance of such other duties from the Department of Public Works as may from time to time seem necessary or advisable in the conduct of the business of the Borough of Westwood.
