The provisions of Chapter 101.123 of the Wisconsin Statutes, as amended by 2009 Wisconsin Act 12, relating to the prohibition of smoking in various enclosed places are hereby adopted and made part of this Code by reference.
The person in charge of a restaurant, tavern, private club, or retail establishment located in the Village of Elm Grove may designate an outside area that is a reasonable distance from any entrance to the restaurant, tavern, private club, or retail establishment where customers, employees, or persons associated with the establishment may smoke.
On Village-owned property smoking is prohibited within 25 feet of an entrance to the Village Hall, Police Department, Fire Department, Library, pool house, and Public Works garage. Smoking is also prohibited in the pool deck area and on the soft surface of the children's playground.
As prescribed by state statues, a warning notice shall be issued to the "person in charge" for the first violation. Penalties for violation shall be as provided in § 1-17C of the Village Code of Ordinances.
