The Board of Trustees recognizes that rising energy costs make it increasingly difficult for its citizens to be able to heat their homes during the winter months. The Board further understands that, while outdoor furnaces may provide an economical alternative to conventional heating systems, there are concerns regarding the safety and environmental impacts of these heating devices, particularly in a village setting where many of the homes are in close proximity to one another. The Board thus determines that the use of outdoor furnaces creates noxious and hazardous smoke, soot, fumes, odors and air pollution that can be detrimental to its citizens' health and can deprive neighboring residents of the enjoyment of their property. By enactment of this chapter, the Board of Trustees intends to secure and promote the public health and welfare by prohibiting the use of outdoor furnaces in the Village of Walden.
As used in this chapter, the following terms shall have the meanings indicated:
OUTDOOR FURNACE
Any accessory appliances designed and intended, through the burning of wood and/or any other combustible, for the purpose of heating the principal structure or any other building on the premises.
The construction, installation and operation of outdoor furnaces are hereby prohibited within the Village of Walden.
Any person who shall violate the provisions of this chapter shall be guilty of a violation and shall, upon conviction, be subject to a fine of not more than $250 or to a term of imprisonment of not more than 15 days, or both such fine and imprisonment. Each week's violation shall constitute a separate and distinct offense. Compliance with this chapter may also be compelled and violations restrained by order or by injunction of a court of competent jurisdiction.
