This chapter shall be known as the "Traffic Control, Parking and Roadways Ordinance," as duly advertised and adopted.

A. 

Words and phrases used in this chapter shall have the applicable meanings ascribed to them in the Vehicle Code

B. 

As used in this chapter, the following terms shall have the meanings indicated:

PARKING
The leaving of a vehicle unattended for any purpose for any period of time, except that the temporary parking of emergency vehicles shall be considered exempt.
PUBLIC ROADWAY
Any area of land dedicated as public right-of-way and accepted by the Township Supervisors for the use of vehicular traffic, including roads, streets, lanes and alleys. Placement of all utilities and drainage facilities within the public right-of-way is encouraged.
ROADWAY OPENINGS
Any activity which requires the cutting or opening of an area within the public right-of-way for the installation or repair of new or existing utilities or facilities.
THROUGH HIGHWAY
Those roadway segments within the municipal boundaries of Daugherty Township designated as legislative routes (LR) or state routes (SR).

The driver of a vehicle shall stop in obedience to a stop sign at an intersection where a stop sign is erected at one or more entrances thereto. Stop signs shall be erected at such street intersections as shall be designated by resolution of the Board of Supervisors. Failure to bring a vehicle to a full stop within a reasonable distance of the intersections designated herein shall constitute a violation of this chapter or the Vehicle Code of Pennsylvania,

where applicable, and subject the operator of said vehicle to penalties and fines as enumerated in said code or this chapter.

A. 

From and after the effective date of this chapter, all designated LR (legislative route) or SR (state route) roadways are hereby classified as "through highways."

B. 

It shall be unlawful for the driver or operator of any vehicle, street car or public transit carrier, except as otherwise provided in the chapter, before entering a through highway to fail to come to a full stop, within a reasonable distance, before entering the intersection on such through highway, when an official "THRU TRAFFIC STOP" or "STOP" sign or signs have been erected in accordance with the provisions of this chapter.

C. 

The driver or operator of any vehicle, street car or public transit carrier shall not be subject to the provisions of this chapter during the hours when a traffic signal is actually in operation or when a state or local police officer is actually on duty directing traffic.

D. 

This chapter shall not apply to vehicles, when operated with due regard for safety, under the direction of the police in the chase or apprehension of violators of the law or persons charged with or suspected of any violation, nor to fire department or fire patrol vehicles responding to a fire alarm, nor to ambulances when traveling in emergencies. The exemption, however, shall not protect the driver of any such vehicle from the reckless disregard of the safety of others.

E. 

The following intersections and or streets located in the Township are hereby declared to be stop intersections, and official stop signs shall be erected (or are hereby confirmed if heretofore erected) in such a position as to face traffic approaching the second-named street in the direction or directions hereby indicated. All vehicles approaching the intersection upon the first-named street in the direction or directions hereby indicated in each case shall come to a full stop, within a reasonable distance, before entering said intersection:

The following intersections are hereby declared to be four-way stop intersections and official stop signs shall be erected (or are hereby confirmed if heretofore erected) in such a position as to face traffic approaching the intersection on each named street:

(1) 

Russell Drive and Grove Street.

(2) 

Woods Drive and Rayz Street.

(3) 

Russell Drive and Rayz Street.

G. 

The Daugherty Township Police Department or Pennsylvania State Police shall be responsible for the enforcement of the provisions of this section.

H. 

Turning restrictions. The following intersections are hereby declared to have turning restrictions, and any vehicle traveling on a street approaching an intersection on which a no-left- or no-right-turn sign has been erected shall be prohibited from making such a turn as required by the Pennsylvania Vehicle Code:

(1) 

Vehicles traveling north on Klein Road and approaching the intersection of Wises Grove Road shall be prohibited from turning left onto Wises Grove Road.

(2) 

Vehicles traveling west on Wises Grove Road and approaching the intersection of Klein Road shall be prohibited from turning left onto Klein Road.

(3) 

Vehicles traveling south on Route 65, Mercer Road, and approaching the intersection of Valley Avenue shall be prohibited from turning left onto Valley Avenue.

It shall be unlawful to park or leave standing or unattended for any period of time any motor vehicle or part thereof on or along the public roads, streets or alleys in Daugherty Township, Beaver County, Pennsylvania, as described herein, or in such manner as to do damage thereto or interfere with or endanger traffic thereon.

A. 

Parking shall be prohibited on all roads and streets in Daugherty Township accepted for maintenance at all times at the following locations, where official signs so indicating are erected:

The Daugherty Township Police Department or Pennsylvania State Police shall be responsible for the enforcement of the provisions of this section.

Any vehicle traveling on a street approaching an intersection on which a yield traffic sign has been erected shall yield the right-of-way as required by the Pennsylvania Vehicle Code.

Any vehicle shall be driven on streets hereinafter designated, or hereafter designated by resolution, as one-way streets only in the direction designated by the appropriate one-way-street sign.

A. 

Pursuant to the provisions of the Vehicle Code, Act 151 of 1998, 75 Pa.C.S.A. § 3362(a)(1.2), as amended, dated January 31, 2000, the following public roads and streets of Daugherty Township are not state-designated highway routes and are functionally classified as local highways:

B. 

Except when a special hazard or where other circumstances exist that require a lower speed for the safe and prudent operation of a vehicle, the maximum speed limit on the Township roads and streets designated in Subsection A above shall be 25 miles per hour.

C. 

No maximum speed limit established under this section shall be effective unless posted on fixed traffic control devices and posted at the beginning and end of each speed zone and at intervals of not greater than 1/2 mile.

D. 

Any person who violates this section is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $35. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $2 for each mile per hour in excess of five miles per hour over the above-established maximum speed limit.

The Chief of Police of the Township of Daugherty shall have the following powers to regulate traffic and parking temporarily and in times of emergency:

A. 

In the case of fire, flood, storm or other emergency, to establish temporary traffic and parking regulations.

B. 

In the case of emergency or to facilitate public works or in the case of the conduct of processions and public events, to restrict or prohibit parking or traffic in limited areas for periods of not more than 24 hours.

C. 

Such temporary and emergency regulations shall be enforced in the same manner as permanent regulations. Any person who shall operate a vehicle in violation of any such regulation shall be liable to the penalty set forth in the law for such violation.

D. 

The Chief of Police shall further have the power and authority to establish, change and abolish, and to designate by appropriate marking or signs, crosswalks, traffic lanes and parking spaces.

All traffic and parking regulations of a permanent nature shall be enacted as ordinances or as parts of ordinances or as amendments to ordinances of the Township of Daugherty.

A. 

Parking. It shall be unlawful to park any vehicle upon the side of any street where a properly posted "No Parking" sign is erected. Official signs prohibiting parking shall be erected upon the sides of such streets as shall be designated by resolution of the Board of Supervisors.

B. 

One-way streets. No person shall operate a vehicle on any street or portion thereof which is properly posted as a one-way street other than in the direction established by such posting. Such streets shall be designated as one-way streets and official signs erected thereon as are established by resolution of the Board of Supervisors.

C. 

Speed limits. Speed limits may be established from time to time upon streets and alleys in the Township by resolution of the Board of Supervisors. Upon such designation, official signs shall be erected upon such streets and alleys so designated with speed limits. Minimum engineering studies, as determined by the Pennsylvania Department of Transportation, shall be the standard used.

D. 

Load limits. The maximum weight of vehicles using the streets and alleys in the Township shall be as designated from time to time by resolution of the Board of Supervisors.

E. 

Traffic regulations. The Board of Supervisors may, from time to time, establish certain regulations regarding the use of streets and alleys in the Township by vehicles and provide penalties for violation thereof.

The following procedures and minimum fines are hereby established:

A. 

Failure to stop at certain intersections. Upon conviction of a summary offense by the Magisterial District Judge having jurisdiction, an operator of a vehicle violating § 162-4 of this chapter shall pay a minimum fine of $100 plus all filing and court costs.

B. 

Parking violations. Any person parking upon streets so designated as prohibited for parking or owners of a vehicle so parked shall pay a minimum fine of $25 plus all filing and court costs, upon conviction of a summary offense by the Magisterial District Judge having jurisdiction.

C. 

Violation of one-way street regulations. Any person operating a vehicle in violation of § 162-7 shall, upon summary conviction by a Magisterial District Judge having jurisdiction, pay a minimum fine of $100 plus all court costs and filing fees.

D. 

Violation of yield intersection. Any person operating a vehicle in violation of § 162-6 shall, upon summary conviction by a Magisterial District Judge having jurisdiction, pay a minimum fine of $100 plus all court costs and filing fees.

In the case of nontraffic offenses, notice by certified mail of violation shall be forwarded to the person, firm, corporation or utility in violation of the provisions of this chapter so identified in the notice by the Township Zoning and Codes Officer or duly authorized personnel. Said notice shall state a deadline for compliance and describe the nature of the violation.
