The following words, when used in this chapter, shall have the following
meanings:
In addition to its generally accepted meaning shall also
mean the owner of the real estate in front of which any sidewalk improvement
is made or to be made in the Borough of Hawthorne.
The Borough of Hawthorne.
The Clerk of the Borough of Hawthorne.
The duly designated or appointed engineer of the Borough
of Hawthorne, or any person employed by the Borough of Hawthorne to
perform any engineering services for the Borough of Hawthorne.
The Municipal Council of the Borough of Hawthorne, being
the governing body of said Borough.
An improved portion of a street or road abutting the edge
of roadway pavement and forming a break between the edge of roadway
pavement and adjoining lands or sidewalk.
Includes silt, mud, dirt, fill, earth, stones and materials
of any kind, as well as debris.
The person employed by the Borough of Hawthorne in charge
of the Department of Public Works, Parks and Recreation, being the
officer of said Borough in charge of public improvements, and shall
include his representatives and inspectors as may be assigned and
working under his supervision and control.
The improved portion of a driveway between a sidewalk and
a street or road.
Removing, digging in, disturbing, excavating or taking up
any surface, pavement or soil of any street, highway, lane, alley,
court, or public place in the Borough of Hawthorne recognized as a
street, highway, lane, alley, court, or like public place, including
drop-curbs connecting to such street, by the Borough of Hawthorne.
Incudes a corporation, association, firm and partnership,
as well as an individual, and also a contractor, subcontractor and
employee of a corporation, association, firm, partnership or individual.
Includes a public road, street, avenue, thoroughfare and
any area over which the public travels in the Borough of Hawthorne.
That portion of a right-of-way intended for the use of pedestrians
and located from the curbline to the outside lateral line of the right-of-way.
In a commercial zone, it shall include all of the land utilized for
pedestrian ingress and egress to the commercial premises. The definition
is specifically intended to include paved sidewalks constructed of
any material, including concrete, macadam, stone, brick or other materials,
but shall not include any unpaved or unimproved areas adjoining any
sidewalk or unpaved or unimproved area where no sidewalk has been
installed.
Any street, highway, lane, alley, court, or like public place
in the Borough of Hawthorne recognized as a street, highway, lane,
alley, court, sidewalk or public place, including drop-curbs connecting
to such street, by the Borough of Hawthorne.
The collector of taxes and assessments of the Borough of
Hawthorne.
Includes surface water and any other kind of water.
B.
Whenever in this article any word importing the singular number or
masculine gender is used in describing or referring to any person,
party, matter or thing, the same shall include and apply to several
persons or parties as well as to one person or party, to females as
well as males and to several matters or things as well as one matter
or thing.
Any person, firm or corporation who shall violate this chapter
shall be liable to a fine not to exceed $2,000 or imprisonment for
a term not to exceed 90 days or a requirement to perform community
service for a period not to exceed 90 days.
