There is hereby established with the Borough of Hawthorne a restricted parking area, located along the east side of Grand Avenue, from a point where head-in parking spaces located at Llewellyn Avenue end and including all parallel parking spaces from such point to the intersection with Washington Street, which shall be referred to as the nonresident commuter parking area, and shall be utilized only for nonresident commuter parking in accordance with restrictions and regulations set forth herein. There is also established a resident restricted parking area within the Borough of Hawthorne, at such locations as may be set forth in § 505-70, which shall be utilized only for parking in accordance with restrictions and regulations set forth herein.
No person shall park or leave standing a vehicle in any parking space within any designated nonresident commuter parking area or any resident restricted time limit parking area, during any hour in which parking is restricted or limited, unless the operator of said vehicle, upon entering the parking space, shall display a parking sticker as described herein. Suitable signs identifying said area shall be affixed at said areas, and at various points therein, identifying said areas as the nonresident commuter parking area or the resident restricted parking area.
Applications for parking stickers under this article shall be made in writing on forms provided by the Office of the Borough Administrator. Parking stickers shall be renewable on an annual basis at such times and on such basis as may be determined by the Administrator or his designee all as set forth herein.

A. 
Residents of the Borough of Hawthorne may make application to the office of the Administrator or his designee for a vehicle intended to be parked in the resident restricted parking area, on forms provided by the Administration, together with payment in advance of the fees provided herein, for issuance of a resident parking sticker for such vehicle in the resident restricted parking area. At the time of submission of said application, the resident shall submit a form of proof demonstrating residence in the Borough of Hawthorne in accordance with any rules or regulations established by the Administrator. Upon determination by the Administrative Officer that the evidence submitted by the applicant satisfactorily demonstrates that the applicant is a resident entitled to the issuance of a resident parking sticker, the Administrative Officer shall issue a sticker with the vehicle license plate numbers of the vehicle authorized to be parked in the resident restricted parking area. Subject to availability of spaces, such stickers shall be issued for a period of one year, at a fee of $2, with the year to be the calendar year and running from January 1 to December 31 of each year. The holder of the outstanding sticker shall renew the same annually; provided, however, that application for renewal shall be submitted together with the appropriate fee, not less than one week prior to such renewal. In the event a new resident to the Borough can adequately demonstrate residence but cannot produce a driver's license or vehicle registration indicating residence in the Borough, the Administrative Officer shall be authorized to issue a temporary resident parking sticker at the same cost as may be applicable to an annual sticker.
B. 
A home health care aide rendering such aide to a resident of the Borough may obtain a special purpose parking sticker upon demonstration to the Administrative Officer that aide is being rendered to a resident of the Borough at his or her home, that there is a documented need to provide such services and that there is a need for parking of a vehicle by the home health care aide in an area otherwise restricted by the terms of this article.
A. 
Nonresident commuters may make application to the Administrator or his designee for a vehicle intended to be parked in the nonresident commuter parking area, located on Grand Avenue, on forms provided by the Administration, together with payment in advance of the fees provided herein, for issuance of a nonresident parking identification sticker for such vehicle in the nonresident commuter parking area. Upon submission of an application and payment of the fee provided for herein, the Administrative Officer shall issue a sticker with the vehicle license plate numbers of the vehicle authorized to be parked in the nonresident commuter parking area. Subject to availability of spaces, such stickers shall be issued for a period of one year, at a fee of $600 per year, the one-year period to be the calendar year and running from January 1 to December 31 of each year. From and after July 1 of each year, and subject to availability of spaces, such stickers shall be issued for the remainder of the year at a fee of $300. The holder of the outstanding sticker shall renew the same annually; provided, however, that application for renewal shall be submitted together with the appropriate fee, not less than one week prior to such renewal.
B. 
No person shall leave standing or park a vehicle anywhere within the nonresident commuter parking area between the hours of 7:00 a.m. and 10:00 a.m., Monday through Friday, unless said vehicle is duly registered to a person who has obtained a nonresident parking sticker and has displayed the same as herein provided. No person shall park any vehicle within the nonresident commuter parking area at any time unless said vehicle is parked within any duly marked or identified parking stall in such area.
Any person purchasing a resident or nonresident parking sticker may make application to the Administrator or his designee for the issuance of a replacement parking sticker. The person making such request shall be required to submit such documentation as may be required by the Administrator for the issuance of the replacement sticker, return to the Administrator the originally issued parking sticker, and pay a replacement fee of $2. In addition, any person who has purchased a resident or nonresident parking sticker may make application to the Administrator or his designee for the issuance of a temporary parking sticker for use in a vehicle other than the vehicle registered by the resident or nonresident in circumstances where the registered vehicle is unavailable for use and an alternate vehicle is to be utilized. Temporary parking stickers shall be issued for a period not to exceed one week but may be renewed weekly, nevertheless, upon submission of an application as required herein and payment of the fee associated with the issuance. The fee for a temporary parking sticker shall be $2 for any resident and $10 for any nonresident for each week or portion thereof.

The fees set forth hereunder may be amended by the Municipal Council of the Borough of Hawthorne from time to time, in its discretion, by resolution duly adopted or by ordinance, with such fees to be set forth in Chapter 220 of the Code of the Borough of Hawthorne, Fees.
Identification stickers issued under the above provisions shall be displayed in the rear window of the vehicle on the driver's side in such manner that the same shall be clearly visible from the outside of the vehicle. No vehicle shall remain parked in any designated commuter parking area for more than 24 consecutive hours.
The Chief of Police or his designee may suspend or modify any parking regulation or restriction hereunder in the interest of public safety or public necessity, in the sole and absolute discretion of the Chief of Police.
Any person violating the parking provisions of this article shall be subject, upon conviction, to the penalties provided for parking in restricted or prohibited areas, as otherwise set forth in this chapter, and in addition thereto:
A. 
Any person who is not entitled to receive a resident sticker or who utilizes any resident restricted parking area as a resident and who shall wrongfully affix or display a resident parking sticker to his or her vehicle and park within the resident restricted parking area during restricted hours shall be punished by a fine, upon conviction, not to exceed $2,000 per offense.
B. 
Any person who is not entitled to receive a nonresident commuter sticker or utilize the nonresident Grand Avenue commuter parking area who shall wrongfully affix or display a nonresident commuter parking sticker to his or her vehicle and park within the Grand Avenue nonresident commuter parking area during restricted hours shall be punished by a fine, upon conviction, not to exceed $2,000 per offense.
C. 
Any person who shall knowingly and intentionally provide, assist, or transfer a resident or nonresident parking sticker to a person not entitled to utilize the same shall be punished by a fine, upon conviction, in an amount not to exceed $2,000 per offense.
D. 
Any vehicle found to be wrongfully or illegally parked in any resident restricted or nonresident commuter parking area during the restricted hours or not parked within the stalls designated for parking within such areas shall be towed and stored, at the expense of the owner. This is in addition to any fine which may be imposed upon conviction as otherwise provided in this chapter. For purposes of this chapter, a violation of § 505-26 and the corresponding schedules set forth at §§ 505-69 and 505-70 shall result in the imposition of a fine as may be set forth by resolution adopted by the Municipal Council and as may be amended from time to time. Any vehicle found to be wrongfully or illegally parked in any resident restricted or nonresident commuter parking area during the restricted hours or not parked within the stalls designated for parking within such areas shall be towed and stored, at the expense of the owner. This is in addition to any fine which may be imposed upon conviction as otherwise provided in this chapter.
