A.
Pursuant
to the provisions of Article 6-A of the Village Law of the State of
New York, as amended,[1] a planning board of five members is appointed for the
Village of Walden, Orange County, New York, and the following named
persons are appointed to serve as members of such Planning Board for
the terms following their respective names, to wit: David Lustig for
the term of five years; Horace Simon, for the term of four years;
Daniel Sickler for the term of three years; Clarence Deyo for the
term of two years; and Marcus Millsapugh for the term of one year.

Horace Simon
is hereby designated to act as Chairman of said Planning Board hereby
appointed.
A.
Pursuant
to the provisions of Article 6-A of the Village Law of the State of
New York, the said Planning Board of the Village of Walden, Orange
County, New York, hereby appointed, shall have full power and authority
to prepare a master plan, to make such investigations, maps and reports
and recommendations in connection therewith relating to the planning
and development of the Village as it seems desirable, to report upon
matters referred to it by the Village Board of Trustees or as required
by Article 6-A, as amended, and shall have the authority to employ
experts and to pay for their services and such other expenses as may
be necessary and proper, providing the total expenditures of said
Board shall not exceed the appropriations for its expenses;
B.
Pursuant
to the provisions of Section 178-K, as amended, of the Village Law
of the State of New York, the said Planning Board of the Village of
Walden, Orange County, New York, hereby appointed is authorized and
empowered to approve plats showing new streets or highways in the
Village of Walden, Orange County, New York; and
C.
Pursuant
to the provisions of Section 179-P, as amended, of the Village Law
of the State of New York, the said Planning Board of the Village of
Walden, Orange County, New York, is hereby authorized, simultaneously
with the approval of any plat, either to conform to the zoning regulations
of the land so platted as shown on the Zoning Map of the Village of
Walden or to make any reasonable change therein.
The Clerk of the Village of Walden, Orange County, New York,
is directed to forthwith file with the Clerk of the County of Orange
a certificate showing that the Village Board of the Village of Walden,
Orange County, New York, has authorized its Planning Board to approve
plats showing new streets or highways within the Village of Walden,
Orange County, New York, pursuant to the provisions of Section 179-K
of the Village Law of the State of New York, and that the said Clerk
be requested to write to the County Clerk of Orange County and request
such Clerk, pursuant to the provisions of Section 179-K of the Village
Law of the State of New York, to refuse to file or record in his office
any plat of a subdivision of land showing a new street or highway
until it has approval of the Planning Board of the Village of Walden,
Orange County, New York.
Pursuant to the provisions of Section 179-A, as amended, of
the Village Law of the State of New York, the said Planning Board
of the Village of Walden, Orange County, New York is authorized and
empowered to be the zoning commission and, for the purposes of the
safety, morals and general welfare of the Village of Walden, Orange
County, New York, to recommend to the Village Board of Trustees such
zoning regulations and districts as are necessary to accomplish such
purpose.

The Board of Trustees finds that the Planning and Zoning Boards
have had occasions where such Boards lacked a quorum to conduct business
due to the illness, vacations, work schedules or recusal of its members.
In such instances, applicants, the public and the other attending
members of said Boards have been greatly inconvenienced and the official
business of said Boards has been delayed. The Board of Trustees determines
that it is necessary therefore to authorize the appointment of alternate
members to said Boards to serve in place of absent members so that
official business can be conducted in a timely and efficient manner.
It is the intent of this article to provide for the appointment, terms,
functions and powers of alternate members to the Planning and Zoning
Boards of the Village of Walden.
As used in this article, the following terms shall have the
meanings indicated:
An individual appointed by the Village Manager to serve on
the Village Planning Board or Zoning Board of Appeals when a regular
member is unable to participate on an application or matter before
the respective board, as provided herein.
An individual appointed by the Village Manager to serve on
the Village Planning Board or Zoning Board of Appeals pursuant to
the provisions of the Village Law which first established such boards.
The Planning Board of the Village of Walden as established
by the Board of Trustees pursuant to the provisions of § 7-718
of the Village Law.
The Zoning Board of Appeals as established by the Board of
Trustees pursuant to the provisions of § 7-712 of the Village
Law.
A.
The Board of Trustees of the Village of Walden hereby enacts this
article to provide for a process for appointing alternate members
to the Village Planning Board and Zoning Board of Appeals.
B.
The Village Manager is hereby authorized to appoint up to three alternate
members to the Planning Board and Zoning Board of Appeals for a term
of three years.
C.
The Chairperson of the Planning Board and Zoning Board of Appeals
may designate an alternate to substitute for a member when such member
is unable to participate on an application or matter before the Board.
When so designated, the alternate member shall possess all the powers
and responsibilities of such member of the Board. Such designation
shall be entered into the minutes of the initial Planning Board or
Zoning Board of Appeals meeting at which the substitution is made.
D.
All provisions of state law relating to Planning Board and Zoning
Board of Appeals member eligibility, vacancy in office, removal, compatibility
of office and service on other boards, as well as any provision of
a local law relating to training, continuing education, compensation
and attendance shall also apply to alternate members.
This article is hereby adopted pursuant to the provisions of
§ 10 of the Municipal Home Rule Law. It is the intent of
the Board of Trustees to supersede the provisions of § 7-718
of the Village Law relating to the appointment of members to village
planning boards and § 7-712 of the Village Law relating
to the appointment of members to village zoning boards of appeals.
