The dock areas at the Village Park, on the south side of the Erie Canal west of Union Street and east of Union Street in front of, and running east and west, of the Spencerport Depot & Canal Museum, are reserved for transient boat usage not to exceed 48 hours. No boat may tie up to the docks for any time exceeding 48 consecutive hours in any seven-day period and any time exceeding two periods of 48 consecutive hours during any thirty-day period. For the purposes of this chapter, if a boat is away from a dock for three or fewer hours and then returns, the computation of the consecutive period will not be considered to be broken. For the purpose of this chapter, both of the docks shall be considered as one when computing the times.
Any person violating any of the provisions of this chapter shall be liable and forfeit and pay a penalty of not exceeding $250 or be imprisoned for a period of time not exceeding 15 days, or both.
A. 
Any Town of Ogden police officer, Monroe County Sheriffs Deputy, New York State police officer or any employee of the Village of Spencerport authorized to issue appearance tickets shall have the authority to issue and serve an appearance ticket pursuant to the Criminal Procedure Law for any violation hereof. If an appearance ticket is issued, an answer to such appearance ticket may be made by registered or certified mail, return receipt requested, within five days of the violation, as provided in Subsections B and C of this section, in lieu of personal appearance on the return date at the time and court specified in said appearance ticket.
B. 
If a person charged with the violation admits to the violation as charged in the appearance ticket, such person may complete the answer form hereby authorized by this section and forward such form and appearance ticket to the office specified on such appearance ticket.
C. 
If the person charged with the violation denies part or all of the violation as charged in the appearance ticket, such person may complete the form likewise prescribed for that purpose and forward such form and appearance ticket to the office specified on such appearance ticket. Upon receipt, such answer shall be entered and a new return date established by said office. Such person shall be notified by return mail of the date and place of such return date. If a person shall fail to appear at a return date when such is provided for pursuant to this section, a summons or a warrant of arrest may be issued pursuant to the Criminal Procedure Law.
