Pursuant to the authority of N.J.S.A. 39:4-60, the Borough of Hawthorne is hereby authorized to permit charitable organizations, as defined in N.J.S.A. 45:17A-20, to solicit contributions in the municipal roadways of the Borough subject to the regulations to be promulgated by the Department of Transportation and rules and regulations as may be promulgated by the Municipal Clerk, in consultation with the Chief of Police or his designee. Where the solicitation is to take place on any county road, in addition to municipal roads or otherwise, approval of the Board of Chosen Freeholders of Passaic County must also be obtained. All such solicitation shall take place on Saturdays at such hours as may be reasonably set by the Municipal Clerk, again in consultation with the Chief of Police or his designee.
An application for solicitation shall be submitted by the charitable organization to the Municipal Clerk, who shall review the same and issue a permit upon a determination that the same complies with law. The Clerk may deny the application if more than one charitable organization has made application to solicit at the same time and place or if the solicitation would interfere with other scheduled events such as parades or street fairs. In order to reduce potential conflicts and allow all organizations the opportunity to solicit donations, no organization shall be permitted more than one permit, other than in the case of a rain date, in any three-month period. The Clerk shall report the issuance of permits to the Municipal Council on a monthly basis.
Any person who shall violate any of the provisions of this article shall pay, upon conviction in the Municipal Court of the Borough of Hawthorne, a penalty not to exceed $200.
