No person shall feed or attract in any public park or on any other property, public or private, any wild or stray animals which are not licensed to a resident of the Borough of Alpha and not under the control of any person. The definition of "wild or stray animals" shall include but not be limited to the following: dogs, cats, waterfowl, raccoons, skunks, groundhogs, pigeons and other birds. This article shall not apply to enclosed, elevated bird feeder devices or confined wildlife (for example, wildlife confined in zoos, parks or rehabilitation centers, or unconfirmed wildlife at environmental education centers). This prohibition shall also apply to any conditions by which the feeding of animals creates a public health risk or unsanitary conditions.
This article shall be enforced by the contracted police department, the Health Department, and/or other municipal officials and/or designees of the Borough of Alpha. Any person found to be in violation of this article shall be ordered to cease the feeding immediately.
Any person(s) found to be in violation of the provisions of this article shall be subject to a fine of at least $50 but not to exceed the sum of $1,000.
