Pursuant to N.J.S.A. 47:1A-1 et seq., all requests
for public records shall be submitted in writing on an official records
request form provided by the Township Clerk, the Police Department
or Court Administrator. Requests shall be responded to by the appropriate
department as soon as possible, but not later than seven days, except
in extenuating circumstances that precludes compliance within seven
days. In the event the request is denied, the custodian of said record(s)
shall state in writing on the OPRA records request form the reason(s)
for said denial. Denials shall include information about the OPRA
appeal rights.
If the Township can demonstrate that the actual cost for duplication exceeds the foregoing rates, the Township shall charge the actual cost of duplicating the record. Actual cost shall be the cost of materials and supplies used to make a copy of the record but shall not include the cost of labor or other overhead expenses associated with making copies except as provided in Subsection C of N.J.S.A. 47:1A-5.
