The Council of the Borough of Red Hill of Montgomery County hereby signifies its intention and desire to organize a Planning Commission under the provisions of the Pennsylvania Municipalities Planning Code, Act 247 of July 31, 1968, as amended.

The Planning Commission shall consist of five members, all of whom shall be citizens of the Borough of Red Hill of Montgomery County. The term of office of the members shall be four years or until a successor is appointed, except that the terms of the members first appointed shall be so fixed that no more than two members of the Commission shall be reappointed during any future calendar year. In the event of vacancies, the Borough Council shall appoint a member to fill the unexpired term. Members whose terms have expired shall hold office until their successors have been appointed.

The Council of the Borough of Red Hill shall appoint any and all members of the Planning Commission by resolution; the Council can remove any member of the Planning Commission for cause including, but not limited to, failure to perform the necessary duties of a member of a Planning Commission. By resolution, the initial appointments shall be for the following terms:
A. 
One year — to terminate as of December 31, 1986.
B. 
Two years — to terminate as of December 31, 1987.
C. 
Three years — to terminate as of December 31, 1988.
D. 
Four years — to terminate as of December 31, 1989.
E. 
Four years — to terminate as of December 31, 1989.

1. 
The Planning Commission shall, at the request of the Borough Council, have the power and shall be required to:
A. 
Prepare the comprehensive plan for the development of the Borough as set forth in this Part 4C, and present it for the consideration of its Borough Council.
B. 
Maintain and keep on file records of its actions. All records and files of the Planning Commission shall be in the possession of the Borough Council.
2. 
The Planning Commission, at the request of the Borough Council, may:
A. 
Make recommendations to the Borough Council concerning the adoption or amendment of an Official Map.
B. 
Prepare and present to the Borough Council a zoning ordinance and make recommendations to the Borough Council on proposed amendments to it as set forth in this Act.
C. 
Prepare, recommend and administer subdivision and land development and planned residential development regulations, as set forth in this Act.
D. 
Prepare and present to the Borough Council a building code and a housing code and make recommendations concerning proposed amendments thereto.
E. 
Do such other act or make such studies as may be necessary to fulfill the duties and obligations imposed by this Act.
F. 
Prepare and present to the Borough Council an environmental study.
G. 
Submit to the appointing authority of a municipality a recommended capital improvements program.
H. 
Promote public interest in, and understanding of, the comprehensive plan and planning.
I. 
Make recommendations to governmental, civic and private agencies and individuals as to the effectiveness of the proposals of such agencies and individuals.
J. 
Hold public hearings and meetings.
K. 
Require from other departments and agencies of the Borough such available information as relates to the work of the planning agency.
L. 
In the performance of its functions, enter upon any land to make examinations and land surveys with the consent of the owner.
3. 
The Planning Commission shall review all applications for building permits in all zoning districts within the Borough except R-1 Residential, R-2 Residential, R-3 Residential and R-4 Residential, as well as all applications for building permits which are claimed to be nonconforming uses or nonconforming lots in any district. The Zoning Officer/Building Inspector shall furnish any such application to the Planning Commission immediately after the same has been filed, and the Planning Commission shall review the same in a timely manner in order that all applicable statutory time limitations may be complied with.
A. 
If the Planning Commission, upon such review at a public meeting, shall find the issuance of such building permit to be in conformity with all applicable laws, ordinances and regulations of the Borough and of the Commonwealth of Pennsylvania, notice thereof shall be given to the Zoning Officer/Building Inspector, and he shall thereupon issue the building permit in question, upon payment of the required fees.
B. 
If the Planning Commission, upon such review at a public meeting, shall find the issuance of such building permit to be in conflict with an applicable law, ordinance or regulations of the Borough or of the Commonwealth, notice thereof shall be given to the Zoning Officer/Building Inspector.

The Planning Commission may, with the consent of the Borough Council, accept and utilize any funds, personnel or other assistance made available by the County, the Commonwealth or the Federal government, or any of their agencies, or from private sources. The Borough Council may enter into agreements of contracts regarding the acceptance or utilization of the funds or assistance in accordance with the governmental procedures of the Borough.
