The provisions of this Part are designed to secure, promote and protect the public health, safety, morals and general welfare of the residents of the Borough of Red Hill and to reduce the dangers of fire within the school buildings and facilities in the Borough.

The following words and terms when used in this Part shall have these stated meanings:
FIRE MARSHALL
The duly appointed Fire Marshall of the Borough of Red Hill or any duly appointed Deputy Fire Marshall.
"NO SMOKING" SIGN
A sign or placard indicating to the viewer that smoking, as hereinafter defined, is prohibited, the content lettering, size, color and location of which sign shall be as designated by the Fire Marshall.
SMOKING
Possession of a cigarette, pipe, cigar or similar object formed of or containing tobacco or other vegetable substance which is ignited or lit and emits smoke.

Upon proper posting of "no smoking" signs, smoking shall be prohibited at all times in all school buildings, school buses and school facilities within the Borough of Red Hill. The Fire Marshall is further authorized to order and direct the posting of "no smoking" signs at the entrance or entrances to all school premises.
A. 
"No Smoking" Signs. The Fire Marshall is hereby authorized to order and direct the posting of "no smoking" signs in each school building, structure, facility, room or place within a school and in all school buses whose routes begin or terminate in the Borough of Red Hill. The Fire Marshall is further authorized to order and direct the posting of "no smoking" signs at the entrance or entrances to all school premises.
B. 
Removal of Signs Prohibited. It shall be unlawful for any persons to remove, obscure, deface, mutilate or destroy any posted "no smoking" sign.

The primary responsibility for the enforcement of this Part shall rest with the school authorities duly constituted. The Fire Marshall shall have secondary enforcement responsibility for this Part.

Any person, firm or corporation who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not less than $25 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.
