As used in this Part, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
ACTIVE RECREATION
Recreational activities usually of a more formal nature and performed with others, often requiring equipment, and taking place at prescribed places, sites, courts or fields including but not limited to playing baseball, basketball, soccer or volleyball.

DESIGNATED USE AREAS
Areas of Borough parks that Borough Council may from time to time designate as active recreation areas for the purpose of allowing certain activities that shall take precedence over other uses in the designated area.

PARK and PARKS
Unless specifically limited, shall be deemed to include all recreation areas, structures, facilities, entrances and approaches thereto, and all other land or property or structures under the jurisdiction of the Borough Council, now or hereafter owned, acquired or legally managed by the Borough for recreational and leisure activity purposes.
PASSIVE RECREATION
Recreational activities that are commonly unorganized and noncompetitive including but not limited to picnicking, walking, birdwatching, activities for young children, and the use of pavilions, pathways, benches and tot lots. All parks are considered passive recreation areas unless otherwise designated by Borough Council as active recreation areas.

PERSON
Any natural person, corporation, organization of persons, company, association or partnership.
RULES AND REGULATIONS
Any rules and regulations hereby or hereafter promulgated by the Borough Council under the authority herein conferred.

A. 
All parks shall be opened daily to the public from dawn to dusk or at such hours as the Borough Council may, from time to time, designate.
B. 
Park activity, use and conduct guidelines shall be posted in each park and available from the Borough upon request.

Public use, activity and conduct in parks shall be governed by existing Borough ordinances and all other applicable rules, laws and regulations of Commonwealth of Pennsylvania and United States of America. The following additional rules and regulations shall apply to all parks and designated use areas within parks:
A. 
All laws pertaining to vandalism of public spaces in the commonwealth as defined in the Commonwealth Title 18 (Crimes and Offenses), Section 3304 (Criminal Mischief), shall apply and provisions are hereby incorporated by reference.
B. 
All laws pertaining to the operating, stopping or parking of any means of conveyance is incorporated by reference as per the Code of Ordinance of the Borough of Red Hill Chapter 15 (Motor Vehicles and Traffic), Part 2 (Traffic Regulations), Section 215 (Operation of Motor Vehicles Restricted on Public Lands).
C. 
All laws pertaining to the disturbance of the peace, such as use of threatening, abusive, profane or obscene language and immoral acts as defined in the Commonwealth Title 18 (Crimes and Offenses), Section 5503 (Disorderly Conduct) and Section 5901 (Open Lewdness), shall apply and provisions are hereby incorporated by reference.
D. 
All laws pertaining to firearms and weapons, or other missile propelling instruments, or arrows or any dangerous weapon are incorporated by reference as per the Code of Ordinance of the Borough of Red Hill Chapter 6 (Conduct), Part 1 (Firearms and Weapons).
E. 
Any violations of the fireworks restrictions of the applicable sections of the International Fire Code shall be subject to the penalties established under the Code of Ordinance of the Borough of Red Hill Chapter 5 (Code Enforcement), Part 1 (Pennsylvania Construction Code), Section 107 (Penalties).

No person in attendance at a park shall:
A. 
Litter any area of the park with garbage, paper, bottles, cans or other waste material, nor dispose of the same in any way except in receptacles designated for such purpose.
B. 
Kindle or maintain any fire in the park except in fireplaces or areas specially designated for that purpose and located by authority of the Borough Council.
C. 
Injure, deface, destroy or remove any notice, rule or regulation posted at any place within the park by authority of the Borough Council, nor shall any notice or placard be posted within the park other than by authority of Borough Council or its designee.
D. 
Hunt for, capture, attempt to capture or kill, or aid or assist in the capturing or killing of, in any manner, any bird or animal of any description, in any park unless specific permission is granted for a designated area by authority of the Borough Council.
E. 
Set up any booth, table or stand for the sale of any article or service whatsoever within the limits of the park without permission of the Borough Council; distribute, sell, service or rent any services or commodity or solicit for any purpose without permission of the Borough Council.
F. 
Operate petting zoos or inflatable devices such as but not limited to bounce houses or inflatable slides.
G. 
Bring onto the premises, possess or consume any alcoholic beverage or illegal drugs of any kind; no person shall enter the park in an intoxicated state or otherwise be under the influence of alcohol or illegal drugs.
H. 
Play golf, pitch horseshoes, engage in finding buried objects with special detectors, or engage in forms of active recreation, except in those areas which may be designated as active recreation areas or designated use areas by Borough Council.

I. 
Injure, deface, remove or cut any trees, plants, shrubs, turf, buildings, structures, signs or fixtures or any other property of the Borough located within the park.

The Borough Council of the Borough of Red Hill hereby establishes tobacco-free zones pursuant to the Young Lungs at Play initiative of the Pennsylvania Department of Health in accordance with the following provisions.
A. 
Tobacco-free zones shall include any Borough parks in which children customarily play, including, without limitation, the following areas in the Borough parks which are duly posted with the Young Lungs at Play Tobacco-Free Zone placards: tot lots; playgrounds; basketball courts; tennis courts; athletic fields, other athletic and play equipment and any other recreation and play areas that are posted with placards and designated as Young Lungs at Play Tobacco-Free Zones as authorized by Borough Council.
B. 
Consumption or use of tobacco, including, without limitation, smoking or chewing tobacco products, is prohibited in areas clearly posted with placards and designated as Young Lungs at Play Tobacco-Free Zones.
C. 
Smoking is prohibited within 20 feet from areas clearly posted with placards and designated Young Lungs at Play Tobacco-Free Zones.
D. 
In addition to the penalties provided in § 16-112 hereinbelow, any person who after one verbal warning refuses to comply with this § 16-105 be required by a Borough official or police officer to immediately leave the posted tobacco-free zone and be ejected from the Borough park until closing.

The Red Hill Park basketball court and the Marvin B. Godshall Sr. Memorial Park are hereby designated active recreation areas. Authorized users of the Red Hill Park pavilion shall utilize the adjacent Marvin B. Godshall Sr. Memorial Park for permitted active recreation activities. In addition, any area designated by Borough Council as a designated use area, either temporarily or long term, may be used for permitted active recreation.

Any public meeting or other gathering assembled through advertisement or public notice shall require an application for said use and review by a Borough official. Such application shall include the purpose and duration of the meeting or gathering and contact information for the person responsible. Upon review, the Borough may require additional information and that the applicant seek a special event permit as outlined in the Code of Ordinance of the Borough of Red Hill Chapter 13 (Licenses, Permits and General Business Regulation), Part 5 (Special Event Permit).

The use of all parks shall be on a first come, first served basis unless otherwise reserved as follows:
A. 
By annual permission granted by the Borough Council for the scheduling of various league games, etc.
B. 
For school or college athletic games, practice, contests or exhibitions.
C. 
For regularly scheduled school district or municipal recreation programs.
D. 
For use of picnic pavilions upon application and review by a Borough official.
E. 
By permission granted by the Borough Council for a specific requested use.

The Borough Council is authorized to establish additional rules and regulations as deemed necessary from time to time on a temporary or long-term basis. The Borough Council is authorized to suspend rules on a temporary basis for good cause.

Recreation facilities which become hazardous for public use due to weather, water, fire or unforeseeable conditions may be closed only at the discretion of Borough officials.
