The Upper Montgomery Joint Authority (hereafter referred to as "Authority"), by resolution dated June 1, 1982, has established a procedure for authorizing sewer connections upon issuance by appropriate Borough officials of a building permit and has limited each Borough with the Authority's service areas to up to 30 EDUs per year from and after March 19, 1982, noncumulatively. By this Part, the Borough of Red Hill establishes standards for issuance of building permits requiring sanitary sewer connections, in order that the public health may be maintained, sources of pollution eliminated and orderly development within the Borough may be fostered to the end that health hazards be avoided, over-crowding and congestion eliminated and the general welfare benefitted.

Building permits requiring sanitary sewer connections shall be issued, when requests for the same have been made for two or more uses, in the following order:
A. 
A use eliminating a public health hazard, so determined by the Borough Building Inspector in consultation with appropriate authorities, both local and State.
B. 
A use eliminating a source of pollution, so determined by the Borough Building Inspector in consultation with appropriate authorities, both local and State.
C. 
Connection of a facility of public need, as determined by Borough Council.
D. 
An addition to an existing single-family residence.
E. 
An addition to an existing commercial use.
F. 
An addition to existing multifamily residence units.
G. 
An addition to an existing industrial unit.
H. 
A new single-family residence.
I. 
A new commercial use.
J. 
A new multifamily residence unit or units; provided, that the Borough Building Inspector shall make a determination as to how many requested EDUs may be permitted, after considering other likely requests for uses in higher classifications together with the provisions of § 18-203 hereof.
K. 
A new industrial use.

In order that the right of all prospective applicants to be considered for building permits under § 18-202 hereof may be preserved, the following limits shall be placed upon the issuance of building permits requiring sanitary sewer connections:
A. 
Not more than 25% of the annual number of EDU connections permitted by the Authority may be expended in building permits issued through March 31 of each calendar year.
B. 
Not more than 50% of the annual number of EDU connections permitted by the Authority, including those issued through March 31, may be expended in building permits issued through June 30 of each calendar year.
C. 
Not more than 75% of the annual number of EDU connections permitted by the Authority, including those issued through June 30, may be expended in building permits issued through September 30 of each calendar year.
D. 
The balance of EDU connections permitted by the Authority may be issued prior to the end of the calendar year.
E. 
In order for the priorities set forth in § 18-202 hereof to be adhered to, the Building Inspector may, if he deems it appropriate, hold all applications requiring sanitary sewer connections until he shall make determinations as to the issuance of permits on or prior to the dates set forth in subsections (A), (B), (C) and (D) hereof.

The terms and provisions hereof shall in all cases be subject to any provision to the contrary in the resolution of the Upper Montgomery Joint Authority of June 1, 1982, or subsequent amendments thereto, and the provisions of that resolution governing connection fee, procedures and lapses shall be applicable to all permits issued or applied for hereunder.

In all cases where the application for a building permit involves either a new connection to the sewer system or added flow to the existing sewer system through an existing sewer connection, the applicant shall present to the Borough prior to the issuance of a building permit by this Borough a sewer construction permit issued by the Authority.
