Any person or persons, club, firm, corporation, partnership, institution or association, desiring to construct, add to or modify any bathing place or swimming pool or any structure intended to be used for bathing or swimming purposes, indoors or outdoors shall, in addition to any other permits required by law, first secure a permit from the Zoning Officer of the Borough of Red Hill. A fee, as established from time to time by resolution, shall be paid to the Borough for each such permit prior to the issuance thereof.

A "swimming pool" is defined as a fixed body of water, natural or artificial, 12 inches or more in depth with a water surface area of 100 square feet or more that is used entirely or partially above ground.

No private swimming pool shall be built until first a permit is secured from the Borough Zoning Officer. No private swimming pool shall be built closer to any lot line than the applicable setback requirements set forth in § 27-316, Subsection 3H, of the Zoning Ordinance, nor closer than 15 feet to any alley of 30 feet or less in ordained width, nor closer than 30 feet, nor shall be built larger than 1/3 of the vacant yard area, nor shall it be allowed to overflow or be drained into the Borough sanitary sewer system, nor be allowed to drain or overflow onto a public right-of-way if it causes a nuisance, nor shall it be constructed or located closer to any ordained street with a width of over 30 feet than is permitted for any other structure in that zone, nor shall it be constructed or located closer to such street than any other structure existent on that lot.

Any floodlighting or any other illumination used in conjunction with the pool shall be shielded and directed away from adjoining properties. All electrical equipment used in conjunction with the pool must meet or exceed the guidelines of the Building Officials and Code Administrators International, Inc. (BOCA). All filters must have a ground fault circuit breaker.

Every bathing place or swimming pool in which water may collect in excess of a depth of 12 inches installed or constructed shall be entirely surrounded by a substantial chain link fence at least four feet in height and equipped with a gate and key-operated lock of gauge 11 or heavier with a top rail of 1 3/8 inch galvanized steel, a bottom rail of galvanized steel, line poles of 1 5/8 inch galvanized steel embedded in concrete, and terminal poles of two-inch galvanized steel embedded in concrete, or, in the alternative, entirely surrounded by a permanent artificial barrier at least four feet in height and equipped with a gate and key-operated lock, of either masonry construction or full round stockade fencing constructed in such a manner as to afford no external footholds or handholds. A permit may be issued for a bathing place or swimming pool with another type of permanent barrier, if in the judgment of the Zoning Officer and with his written approval, such barrier is equally adequate to make such bathing place or swimming pool inaccessible when locked as the fences and barriers set forth hereinbefore. No bathing place or swimming pool shall be used or filled with water until the same has been inspected by the Borough Zoning Officer and found to be in compliance with the plans submitted and this Chapter.

Above-ground pools with exterior walls over four feet high need not be enclosed by a fence, but the ladders serving the pool shall be of the removable type and shall be locked in an inaccessible position or removed and locked up elsewhere at any time when an adult is not present at the pool. Where any natural or artificial condition would allow access to an above-ground swimming pool that is not otherwise required to be enclosed by a fence under this Section, the Zoning Officer may in his reasonable discretion order fencing if safety requires.

Every person, firm or corporation owning land within the Borough of Red Hill on which there is situated a swimming pool, bathing place, fish pond or other body of water which constitutes an obvious hazard to children of tender years or which contains or may contain 12 inches or more of water in depth with a water surface area of 100 square feet or more at any point shall erect and maintain an adequate permanent barrier as set forth in §§ 23-105 and 23-106 of this Chapter, which shall surround and enclose such body of water, for the purposes of making such body of water inaccessible to children of tender years when such barrier is locked.

Any person, firm or corporation who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
