A. 
The Building Official, when issuing an order requiring the demolition of a building or structure, shall also serve on the owner thereof written notice of the following:
(1) 
The right of the owner to appeal the demolition order to the Smithfield Board of Review. The notice shall include details as to where, when and how such an appeal may be filed.
(2) 
The right of the owner, at his or her own expense, to provide to the Building Official the report of a professional engineer or architect concerning the condition and safety of the subject building or structure. The Building Official shall consider the professional engineer's or architect’s report and, in his or her discretion, may reconsider the decision to issue the demolition order.
(3) 
The right of the owner to seek advice and assistance from social service agencies such as the Rhode Island Department of Elderly Affairs. The Town Manager shall maintain a current list of the names and contact information for such agencies. This list shall be provided to the owner along with the demolition order.
B. 
The notice provided for herein shall be served on the owner in the same manner as the demolition order.
C. 
Except in the case of a hazardous building which creates an immediate danger to public health, safety and welfare as defined by G.L. § 23-27.3-125.5, the Building Official shall give at least 72 hours' advance written notice to the Smithfield Historic Preservation Commission of his or her intent to issue a demolition order so that said Commission may evaluate the building’s eligibility for inclusion in the Smithfield Historic Inventory.
