"WHEREAS, the administration of the public affairs of this municipality requires the employment of a qualified person to coordinate the activities of the various departments and to assure the continued efficient and economical operation thereof for the benefit of the residents of this Township, and
"WHEREAS, in the opinion of the Township Committee, this need can be best fulfilled by the creation of the office of Township Administrator and the appointment of a proper person to fulfill the duties of such office on a full-time basis."
The position of Township Administrator of the Township of Upper Deerfield is hereby created, and employment of a qualified person for that position is hereby authorized.
The Township Administrator shall be appointed by the Mayor, with the advice and consent of the Township Committee. After the effective date of this article, the first appointment of the Township Administrator shall be for a term to end August 1, 1979, and thereafter the Township Administrator shall hold office for a term of three years from August 1, 1979, and until his successor has been appointed and qualifies. The Township Administrator shall receive as salary such sums as may be fixed and adopted by the Township Committee in the Salary Ordinance from time to time,[1] and in addition thereto he shall be reimbursed for all reasonable expenses necessarily incurred in the performance of the duties of his office.

The Township Administrator shall devote full time to the interests of the Township and shall not hold any other employment, unless expressly approved by the Township Committee, except that nothing herein shall prevent the Administrator from holding other positions in the Township of Upper Deerfield to which he has been appointed in accordance with the laws of the State of New Jersey, and the Township Administrator may also serve as Planning Consultant for the Township and perform such duties in connection therewith as may be assigned by the Township Committee from time to time.
The Township Administrator shall be appointed on the basis of executive and administrative qualifications, with special regard to education and training in business and government affairs and experiences therein. No member of the Township Committee may be appointed as Township Administrator during the term for which he was elected to serve as a member of the governing body. Residence within the Township of Upper Deerfield shall not be a qualification for appointment as Township Administrator, and any person holding such office may not be required to reside within this municipality.
Subject to the supervision and control of the Township Committee, the Township Administrator shall conduct necessary studies and make recommendations to the Township Committee in all matters affecting the business affairs of the Township, pursuant to legislative action by the governing body. Without limiting the foregoing and to the extent not prohibited by law, the Township Administrator shall have the authority and responsibility and shall perform the duties hereinafter set forth as follows:
A. 
Perform the general executive and administrative duties which may be necessary and proper for the comprehensive and efficient exercise of municipal government.
B. 
Implement, carry out and enforce the ordinances, resolutions, motions, policies and specific procedures and directions adopted by the Township Committee pursuant to its legislative power, as necessary to exercise fully the executive and administrative powers thereof.
C. 
Supervise the administration of all departments and offices in consultation with the respective department head(s) and Township Committee member(s) designated therefor and assign responsibility for all required, necessary and proper executive and administrative action and coordination of operations.
D. 
Implement and enforce personnel organization and policy of the Township and its departments, branches, offices and agencies (hereinafter referred to collectively as "departments").
E. 
Implement and enforce administrative procedures and policies of the Township and its departments.
F. 
Implement and enforce procedures and policies of the Township and its departments for requisition, purchase, inspection, receipt, storage, distribution, internal transfer and disposal of, and for standards and specifications and payment for, supplies, services, materials and equipment.[1]

G. 
Negotiate contracts for the Township as authorized by and subject to approval of the Township Committee and the Township Attorney.
H. 
Implement and enforce all terms and conditions imposed in favor of the Township or its citizens in any statute, public utility franchise, performance bond or other contractual undertaking or obligation and, upon knowledge, call any violation, default or omission to the attention of the Township Committee.
I. 
Implement and enforce procedures and policies of the Township and its departments for internal communications and public information.
J. 
Receive and reply in writing to inquiries and complaints concerning Township business and provide information and assistance in respect thereto.
K. 
Act as liaison between the Township of Upper Deerfield and the various county, state and federal agencies with respect to all applications for funds and/or services needed or required by the Township of Upper Deerfield.
L. 
Implement and enforce the financial and accounting policies and procedures of the Township and its departments in consultation with the Township auditors.
M. 
Approve all vouchers and bills jointly with the Township Clerk and assist the Township Clerk in reviewing and submitting the same to the Township Committee for final approval and generally supervising the disbursements of all Township funds.[2]

N. 
Study and recommend to the Township Committee, with the concurrence of the Township Treasurer, a program for the prudent investment of such funds as temporarily may be in excess of the amount needed to meet Township obligations.
O. 
Assist the Township Clerk in the preparation of a thorough and complete proposed Township budget after requiring and receiving appropriate requests from heads of the departments and reviewing such requests with the Township Clerk and Township Committee with respect thereto, and assist the Township Clerk in the submission in a timely manner of a final recommendation in the form required by law for municipal budgets, appending thereto a detailed analysis of the various items of expenditure and revenue and such explanatory comment or statement as may be deemed advisable.
P. 
Study and recommend, with the concurrence of the Township Planning Board, the nature, location and extent of public improvements and coordinate the execution of same when authorized by the Township Committee.
Q. 
Develop, implement and administer, with the concurrence of the Township Clerk, a comprehensive program of insurance for the Township, as authorized by and subject to the approval of the Township Committee.
R. 
Assume responsibility for the overall supervision and maintenance of real property owned by the Township, in accordance with instructions or any program approved by the Township Committee.
S. 
Attend all regular and special meetings of the Township Committee, except when excused, with the right to participate in discussions but without the right to vote.
T. 
Keep the Township Committee currently, fully, promptly and accurately informed of all matters within the jurisdiction of the office of Township Administrator by such reports and in such manner as deemed advisable and as may be requested by the Township Committee.
U. 
Perform such other duties, powers, functions and responsibilities as may be required or imposed by the Township Committee.
In every instance where the Township Committee is referred to in this article, the said Committee may, where permitted by law, designate one or more of its members as an individual or a committee to act in its place and stead, in which case the Township Administrator shall deal in the first instance directly with said individual or committee rather than with the Township Committee at large.
Nothing herein shall derogate from or authorize the Township Administrator to exercise the powers and duties of elected and appointed officials of the Township and of the boards and agencies thereof established pursuant to law.
During any approved absence or disability of the Township Administrator, an officer or employee of the Township may be appointed by the Township Committee to temporarily perform the duties and responsibilities of the position.
The Township Administrator may be removed from office for cause by a three-fifths vote of the full membership of the Township Committee, provided that such removal shall be made only after public hearing on a written complaint of a member of the Township Committee, setting forth the reasons for such removal, which complaint shall be filed with the Township Clerk, and thereafter a copy of said complaint and 20 days' written notice of the time and place of such hearing shall be delivered to the Township Administrator in person or by certified mail, addressed to his last known post office address, and delivery by mail shall be complete upon mailing.
The Township Administrator shall maintain an office in the Municipal Building or such other place as may be designated by the Township Committee, which office shall be open to the public for the transaction of public business during such days and hours as may be fixed by the Township Committee from time to time.
