A. 
All buildings or structures existing at time of installation of water mains, having a potable water supply and located on property abutting or provided access from any street wherein there is located or will be located a public water main, shall be connected to the public water supply main within 60 days after installation of said water main, except as provided in § 396-54 herein. All buildings and structures which are constructed after the installation of public water supply mains and having frontage on or access to roads or streets served by public water supply mains shall be connected to the public supply system prior to the issuance of a certificate of occupancy for such building or structure. No owner or person in possession of property connected to a public water supply system shall suffer or permit water to be diverted therefrom or supplied to any other property.
B. 
The above requirement will not apply to that section of a water transmission main on Centerton Road between Big Oak Road and South Burlington Road for a period of five years, commencing on the date certified by the Cumberland County Engineer as the completion date of the County's Centerton Road Reconstruction Project. This five-year period shall automatically terminate five years from said completion date, but in no case less than five years from the date of adoption of this section. This exemption to the requirements of this section may be extended by resolution of the Township Committee for additional periods of time and at the sole discretion of the Township Committee.
C. 
In the case of any development, building, or structure located on a property abutting or provided access from any street where there is located or will be located a public water main, such property shall be connected to the public water supply system of the Township, and said connection shall be made and operational prior to the issuance of a certificate of occupancy. If, in the opinion of the Engineer of the Township of Upper Deerfield, any new building or structure which is connected to the water supply system of the Township of Upper Deerfield shall require additional piping or continuous water flow distribution systems in order to maintain adequate pressure, flow, etc., then upon the recommendation of the Township Engineer, the construction and connection of additional water facilities may be required. Additional water facilities include, but are not limited to, continuation of the water system back to the main or trunk water distribution line. It is the expressed desire of the Township to have water mains looped back to the water distribution network.

D. 
For each connection to a building or dwelling of a meter, a tap into the water main or the installation of a vault or meter box, the Township Water Superintendent, or his designee, shall be required to inspect such work and installations. The property owner shall be liable to pay the Township a fee of $100 for inspection of any or all such work.

A. 
The owner of any building or structure connected to the public water well supply system shall disconnect any private well water supply by an actual break in the plumbing connection, so as to prevent any flow of water from said private well into the public water system or the structure's plumbing and potable water supply. Such disconnection shall be subject to the review and approval of the Township Water System Superintendent, the Township Plumbing Subcode Official and other health agencies having jurisdiction.

B. 
No person shall connect or reconnect any private water supply well to the plumbing system of any structure connected to the public water supply system. Use of water from any private well in any area served by a public water supply system shall be in accordance with this chapter.

The drilling, installation or connection of a new private water supply on any property with access to or abutting a street or road wherein public water supply mains are available shall be prohibited unless and until a permit for such private well is applied for and granted by the Township governing body. Reason for the issuance of such permit shall be for crop irrigation or a bona fide agricultural use.
A. 
Any private water supply well existing and operational on a property at the time a public water supply main is constructed in a street or road abutting said property or having access thereto shall cease to be used as a water supply well for potable purposes. All disconnected wells that are to be abandoned shall be sealed in accordance with the New Jersey Administrative Code (N.J.A.C.) 7:9-9.1 et seq., as amended. Sealing shall only be performed by a New Jersey licensed well driller who is certified to seal wells.

B. 
The owner of an existing private well may apply to the New Jersey Department of Environmental Protection for a permit for the continued use of such well for irrigation purposes. Persons choosing to retain their wells for irrigation purposes shall be required to repermit their wells. Repermitting will require the services of a New Jersey licensed well driller. No cross-connection between the public water supply system and the irrigation well will be permitted. To avoid cross-connections, all internal plumbing from the well must be physically separated from the plumbing connected to the public water supply system. All work shall be subject to the inspection of the Township Plumbing Subcode Official.

C. 
Use of water from an existing water supply well or the issuance of a permit by the Township for said use shall in no way create or establish any liability of any kind or nature whatsoever upon the Township of Upper Deerfield, its agents, servants, employees, officials, successors or assigns. Waiver of such liability shall be formally acknowledged and accepted in writing by any applicant for a permit.
D. 
No permit issued under the provisions of this section shall be transferable.

If the owner of any property in the Township shall fail to make any connection or installation required by this article within the time herein required, the Township may proceed against the property owner to make such connection or installation or cause the same to be made and charge and assess the cost thereof against such property pursuant to the authority of N.J.S.A. 40A:31-1 et seq., and all supplements thereto and amendments thereof.
