[HISTORY: Adopted by the Township Committee of the Township
of Upper Deerfield 7-1-1976 by Ord. No. 150 (Ch. 14 of the 1977 Township

There is hereby created a local industrial commission to be
known and designated as the "Industrial Commission of the Township
of Upper Deerfield in the County of Cumberland."
There shall be appointed by the Mayor seven members of the Commission
for terms of five years each, provided that upon the adoption of this
chapter the initial appointments shall be made so that one member
shall be appointed for a term to expire January 1, 1977; one member
for a term to expire January 1, 1978; one member for a term to expire
January 1, 1979; two members for a term to expire January 1, 1980;
and two members for a term to expire January 1, 1981. Thereafter members
shall be appointed for terms of five years each. Vacancies shall be
filled in the same manner for the unexpired term, and all members
of the Commission shall hold office until their successors are appointed
and qualify.
Each member of the Commission may be a resident or nonresident
of the Township of Upper Deerfield and shall be chosen with a special
view to qualifications and fitness for service on the Commission,
as defined by N.J.S.A. 40:55B-1 et seq., as amended or supplemented
from time to time.

The Commission shall have all the powers provided by statute and
shall meet and organize during the month following the initial appointment
of its members, and thereafter shall meet and organize during the
month of January in each year, and shall choose annually from among
its members a Chairman and a Secretary and such other officers as
it may deem necessary, all of whom shall hold office until the next
following annual meeting of the Commission and until their respective
successors shall have been chosen and shall qualify. Vacancies in
any office shall be filled for the unexpired term. A temporary officer
may be elected to serve during the absence or disability of any officer.
The Commission may elect additional officers and fix their terms of
office. The Mayor of the Township shall be an ex officio member of
the Commission. A majority of the members of the Commission shall
constitute a quorum.

In addition to the powers as provided for in this chapter, the Commission
shall additionally have the right to function as an economic development
committee and utilize, when functioning as said economic development
committee, the title of "Economic Development Committee of the Township
of Upper Deerfield in the County of Cumberland." The Economic Development
Committee, as opposed to the Industrial Commission, shall operate
as an advisory committee and in such advisory capacity shall have
the right to:

Inquire into, survey and publicize the extent, advantages and utility
of vacant land within the Township.
(2)Â
Make advisory recommendations to the Township as to the classifications
of land use according to its adaptability to various types of businesses,
whether professional, commercial and/or industrial.
(3)Â
Study and analyze various businesses, whether commercial or professional,
with a view to ascertain the opportunities for expansion of such businesses,
whether professional or commercial, within the Township.
(4)Â
Make advisory recommendations, in accordance with information obtained,
to the Industrial Commission or to the Township.
Members and officers of the Commission shall serve without compensation,
but each member shall receive his actual disbursements for expenses
incurred in the performance of official duties.
Each member and officer of the Commission shall, before assuming
office, take and subscribe to an oath to faithfully and impartially
discharge the duties of such office. Members of the Commission and
officers shall furnish bonds to the Commission to secure the faithful
discharge of their duties, in form, amount and with such surety as
may from time to time be required by resolution of the governing body
of this Township.
No member, officer or employee of the Commission shall be interested,
directly or indirectly, in any contracts for work or materials used
by the Commission, or in any sales, leases or agreements in connection
with lands, buildings or other property owned or controlled by the
Commission, or in any fees or compensation of any kind paid to any
person doing business with the Commission, or in any other transaction
of or with the Commission.
The Industrial Commission shall constitute a corporate instrumentality
of the municipality, and its general purpose shall be primarily to
promote the proper and orderly industrial growth of the Township and
to exercise the purposes, functions and powers conferred by statute
(N.J.S.A. 40:55B-1 et seq., as amended or supplemented from time to
time), subject to the limitations provided therein.
The Commission shall make its own rules and regulations concerning
the time, place and conduct of its meetings, provided the Secretary
shall keep minutes of all meetings and such meetings shall be open
to the public.
Employees and assistants shall be provided to the Industrial
Commission from time to time by the municipality in the manner designated
by statute (N.J.S.A. 40:55B-6, as amended or supplemented from time
to time), subject to the limitations provided therein.
The Industrial Commission may request from the Township Committee
annually and from time to time an appropriation of funds for operations
of the Commission and may incur expenses therefor within the limitations
of any budget appropriation, and payment of all such expenses shall
be made from the Township treasury upon approval by the Township Committee,
and the Commission shall report thereon to the Township Committee
and shall exercise such powers in the manner conferred by statute
(N.J.S.A. 40:55B-10, as amended or supplemented from time to time),
subject to the limitations provided therein.[1]
