The Township Committee is hereby authorized to license bona
fide organizations to hold and operate games of chance commonly known
as "raffles" in accordance with the provisions of N.J.S.A. 5:8-50
et seq., known as the "Raffles Licensing Law," and the provisions
of the New Jersey Administrative Code, N.J.A.C. 13:47-1.1 et seq.
Licensees must be qualified and games conducted in accordance
with the requirements of N.J.S.A. 5:8-51 and the New Jersey Administrative
Code.
Each applicant for such a license shall file with the Township
Clerk a written application therefor in the form prescribed by the
rules and regulations of the Legalized Games of Chance Control Commission
and shall comply with the provisions of N.J.S.A. 5:8-52 and 5:8-53.
A special license may be issued to any senior citizen association
or club to hold, operate and conduct games of chance solely for the
purpose of amusement and recreation of its members, where no player
or other person furnishes anything of value for the opportunity to
participate: prizes are nominal; only bona fide active members of
the organization participate; and no person is paid for conducting
or assisting in the conduct of the game. Such license shall be issued
without fee and shall be effective for a period of two years.
Upon proper application, the Township Committee may authorize
the issuance of a license for the conduct of a game or games of raffles
on the first day of the week, commonly known and designated as "Sunday."
No person under the age of 18 years shall participate in any
game of chance licensed as provided herein.
All licenses issued and games of chance authorized to be held,
operated or conducted in the Township of Upper Deerfield shall fully
comply in all respects with the statutory provisions of the Raffles
Licensing Law, cited as N.J.S.A. 5:8-50 et seq., and the New Jersey
Administrative Code, cited as N.J.A.C. 13:47-1.1 et seq.
Subject to the immunity provisions set forth in N.J.S.A. 5:8-67,
any person, organization, association, firm or corporation who shall
make any false statement in any application for a license or shall
otherwise violate the provisions of N.J.S.A. 5:8-68 shall be subject
to the penalties prescribed therein.
Any person, organization, association, firm or corporation who
shall violate any of the provisions of this chapter shall, upon conviction
in the Municipal Court of the Township of Upper Deerfield or any other
court having jurisdiction pursuant to law, be subject to a fine not
exceeding $500 or imprisonment in the county jail for a term not exceeding
90 days, or both, in the discretion of the Court. Each and every day
that such violation continues shall be considered a further and separate
offense.
