Rate increases.

(1)Â
The Borough Council for the Borough of Zelienople, Butler County,
Pennsylvania, is hereby authorized to increase the rates charged for
the use and consumption of water. The water rate increase shall take
effect with the March 1, 2010 billings.
(2)Â
The rates to be charged shall be set by the Zelienople Borough Council
through an official resolution of the Council and, once set, may be
changed from time to time by resolution of Council.
B.Â
The above rates are based on service to a single customer
served by a single meter. Where two or more consumers occupy a building
with a single piping and served through a single meter, the gallon
blocks shall be multiplied by the number of consumers served. Where
a single customer or service address is served by two or more meters,
this deposit is applicable to each meter.

A "single consumer unit" is construed as service to any single-family
dwelling so designed and arranged as to provide cooking and kitchen
accommodations for one family only.
D.Â
Where a residence occupied by a customer is also used as a commercial
or business establishment, the piping shall be so arranged as to meter
the business separately or, if separation is not effected, the gallon
blocks shall be multiplied by the number of consumers served.

If not paid on or before the 15th day of the month so issued, a penalty
of 1Â 1/2% per month is hereby imposed, which penalty shall continue
on the same basis until the bill shall be fully paid.

Water surcharge.
(1)Â
A monthly surcharge will be placed on every active water account
in the Borough of Zelienople and will be assessed in addition to the
fee for water consumption and usage. The monthly surcharge will be
calculated on the basis of equivalent dwelling units (EDUs). For purposes
of this article, "EDU" means the method used by the Borough for calculating
water volume capacity for all users in units of volume equivalent
to that used by a single residential dwelling unit. The monthly surcharge
is to be applied to all active accounts so long as a water connection
exists and without recognition of the amount of water consumed. The
amount of the monthly surcharge per EDU shall be established by resolution
of Council.

(2)Â
All water bills for the Borough of Zelienople will, no later than
January 1, 1996, bear the inscription "capital improvement surcharge"
when referencing this amount.

G.Â
An administrative fee of $35 is hereby assessed against any resident
who requests that the Borough turn off the supply of water to his
residence or facility. An additional administrative fee of $35 is
hereby assessed when any customer requests that the Borough begin
supplying or resupplying his residence or facility with water.

Residential consumers.
(1)Â
From and after the effective date of this article,
all residential nonproperty holders applying for water service shall
make a deposit of $50. This amount may be changed by Zelienople Borough
Council by resolution.

If any account of a nonproperty holder becomes delinquent, in addition to discontinuance of service, said deposit shall be applied to said delinquency and service shall not be resumed until said delinquent balance has been paid in full and a new deposit or such portion thereof as is required to meet the deposits above set forth in § 266-2, paid in full and all disconnect and connect fees paid in full.

The property owner is responsible for paying all delinquent
bills in excess of 90 days. Such responsibility can result in liens
being placed on the property.
B.Â
To facilitate the awareness of delinquent bills, the
property owner will be sent a duplicate bill each month when arrears
are indicated.

No person, other than an authorized Borough representative,
may open a curb valve connected to the Borough water system or attach
any wire or fitting to the Borough electric transmission system.

Any person, firm or corporation violating any provision of this
article shall, upon conviction thereof, be sentenced to pay a fine
of not less than $100 or more than $600 plus costs and, in default
of payment of said fine and costs, to a term of imprisonment not to
exceed 30 days.
