§ 17-111 Motor Vehicles Not to be Driven on Sidewalks.

No person shall operate any motor vehicle longitudinally upon any sidewalk in the Borough, nor shall any person operate any motor vehicle upon or across any sidewalk except in order to gain access to or egress from a driveway or alley at such locations where the curb, if such sidewalk is curbed, shall have been properly cut down for the purpose.

§ 17-112 Traffic Signals at Certain Intersections.

At the following intersections, official traffic signals shall be erected (or if heretofore erected are hereby ratified), and traffic at such intersections may be directed by such signals:

The following highways in the Borough are hereby established as through highways, except at such intersections thereof where traffic is regulated by official traffic signals, and the operator of every vehicle, upon approaching any such highway at any intersection thereof, shall come to a full stop, within a reasonable distance, before entering such intersection:

§ 17-117 Vehicles and Tractors to Keep to Right of Center Grassplot on Market Street.

Every person operating a vehicle or tractor on Market Street, at any point between Eighth Street and Tenth Street, shall at all times keep to the right of the grassplot in the center of the said street.

§ 17-118 Play Highways Authorized.

[Ord. 2014-01, 2/18/2014]

The Mayor is hereby authorized to designate as "play highways," whenever he shall deem such action advisable, and for whatever period of time directed by him, any portion of any street or alley in the Borough, whereon sledding and coasting shall be permitted. No person shall operate a motor vehicle or tractor upon any play highway at any time when such highway shall be so designated, except in cases of emergency, with special permission of the Mayor or of the police officer in charge, who shall first clear such highway of all persons using such highway for the purpose for which it was set apart.

§ 17-119 Reckless Driving of Vehicle on Private Property Without Consent of Owner.

No person shall drive any vehicle or tractor on private property without the consent of the owner or other person in control or possession thereof, carelessly disregarding the rights or safety of others or in a manner so as to endanger any person or property.

§ 17-120 Engine Brakes.

[Ord. 2014-01, 2/18/2014]

1. This section shall be known as the "Mifflinburg Borough Engine Brake Ordinance."

2. The Borough Council of the Borough of Mifflinburg, Union County, Pennsylvania, finds as a fact that the operation of an engine brake on a gasoline-powered or diesel-powered motor vehicle not equipped with an exhaust muffler, or equipped with defective or modified exhaust mufflers, so as to create excessive noise through the use of said brake, adversely affects the public health, safety and welfare of the residents of the Borough of Mifflinburg and therefore is a nuisance in fact.

3. No gasoline-powered or diesel-powered motor vehicles shall operate an engine brake not equipped with exhaust mufflers, or equipped with defective or modified exhaust mufflers, so as to create excessive noise through the use of said engine brake on all of the public streets within the Borough of Mifflinburg having a grade of less than 4%, and they shall not be operated on the following state routes within the Borough:

A. State Route 45 from the western Borough line east to the eastern Borough line: 2.01 miles.

B. State Route 2004 (Maple Street) from Third Street east to the Borough line: 0.64 mile.

C. State Route 3003 (Eighth Street) from PA Route 45 north to Laurel Street: 0.91 mile.

D. State Route 3007 (Forest Hill Road) from PA Route 45 north to the intersection of Creek Road: 0.55 mile.

4. This section shall not apply to emergency driving situations requiring the utilization of an engine brake to protect the safety and property of residents of Mifflinburg Borough, other motor vehicle operators, pedestrians and the operator and passenger of the motor vehicle involved in said emergency situation.

5. This section shall not apply to fire or emergency vehicles requiring the utilization of an engine brake to protect the safety and property of the residents of Mifflinburg Borough and other motor vehicle operators, pedestrians and the operator and passengers of the fire or emergency vehicles.

6. This section shall not apply to farming or exempt vehicles when said vehicles are utilized for agricultural purposes.
