If any section or provision, or part thereof, of this Part 2 shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of this Part 2 as a whole or of any section, provision or part thereof not adjudged invalid or unconstitutional.

1. 
In order to facilitate the movement of traffic and to combat the hazards of snow and ice on the streets and roads of this Borough, the Mayor, or the Borough Manager in his or her discretion, may declare a snow or ice emergency (hereinafter referred to as a "snow emergency"). The Borough shall give information on the existence of a snow emergency through radio, newspaper, or other available media, and information regarding the termination of the emergency shall be given by the use of the same media.
A. 
After any snow emergency is declared, it shall be unlawful, at any time during the continuance of the emergency, for any person:
(1) 
To park a motor vehicle or to allow that vehicle to remain parked anywhere on any snow emergency route designated in Subsection 3 below; or
(2) 
To drive any motor vehicle on such snow emergency route, unless that vehicle is equipped with snow tires, four-wheel drive, or chains.
(3) 
The following are designated as snow emergency routes:

B. 
If, at any time during a period of snow emergency declared under this section, a person shall drive a motor vehicle upon a snow emergency route without having that vehicle equipped with snow tires, four-wheel drive, or chains plus adequate equipment to provide sufficient traction to keep such vehicle in motion so that other traffic on such roadway will not be blocked or impeded, that person shall be guilty of a violation of this section and, upon conviction, shall be fined as set forth in § 17-107 herein.
C. 
If, at any time during a period of snow emergency declared under this section, a person shall park a motor vehicle or allow a motor vehicle to remain parked anywhere along a snow emergency route, the person shall be guilty of a violation of this section and, upon conviction, shall be fined as set forth in § 17-107 herein.
D. 
In order to assist operators of motor vehicles in determining the highways affected by this section, there shall be placed on the roads and streets designated in § 17-201, Subsection 1A(3), above, signs reading as follows:

E. 
Whenever any vehicle shall be found stalled, stuck, parked or abandoned on any of the Borough streets during any declared snow emergency, in such manner as to obstruct or impede traffic or hinder snow removal or cindering operations, the vehicle may then be removed (at the owner's expense) pursuant to the provisions and regulations of § 17-301 through § 17-309 of this chapter of the Mifflinburg Borough Code of Ordinances. Only persons authorized by the Borough Manager or the Borough Mayor shall remove such vehicles. Such persons so designated shall notify the Chief of Police immediately following such removal. Such authorized persons shall give the type of vehicle, the license tag number, the place of removal, the time of removal, the cause of removal, the place to which the vehicle was removed, and such other information as the Chief of Police may require. The Chief of Police shall attempt to notify the owner of such vehicle, as soon as it is reasonably possible, of the removal and location of the vehicle. Vehicles exempt from the provisions of this section are as follows:
(1) 
Commercial vehicles making emergency deliveries of fuel oil or motor oils, coal, gasoline, goods, milk, and medicines.
(2) 
Emergency vehicles of public service corporations.
(3) 
Ambulances and vehicles carrying sick or injured persons.
(4) 
Vehicles engaged in snow plowing or removal or cindering operations on Borough streets.
(5) 
Tow trucks.
(6) 
Physicians responding to sick calls.
(7) 
Vehicles carrying United States mail.
(8) 
Police vehicles.
(9) 
Fire vehicles.
(10) 
Government emergency vehicles.
(11) 
Municipal vehicles declared essential by the Borough Manager.
(12) 
Hearses and motor vehicles in processions.
F. 
Continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of a violation may be punished as provided above for each separate offense.

1. 
During any snowstorm (defined as any weather condition in which any accumulation of snow or sleet greater than three inches has fallen or is predicted to fall or in which there has been or is predicted any accumulation of ice), parking shall be regulated on all Borough streets as follows:
A. 
During the course of any snowstorm, parking shall be prohibited on the odd-numbered side of all Borough streets (i.e., house numbers are odd numbers) until such time as plowing, salting, and/or cindering is complete on said side of the street.
B. 
After 8:00 a.m. on the day following any snowstorm, and until after plowing, salting, and/or cindering is completed, parking shall be prohibited on the even-numbered side of all Borough streets (i.e., house numbers are even numbers) until such time as plowing, salting, and/or cindering is completed on said side of the street.
C. 
At all times during and after any snowstorm, it shall be prohibited for any person to shovel, push, throw, or plow snow from a sidewalk, driveway, lot, or any other area into the street.

A. 
After 8:00 p.m. on the day following any snowstorm as defined above, or at such times as posted and/or barricaded by the Borough, parking shall be prohibited on all Borough-owned and maintained public parking lots until such time as plowing, salting, and/or cindering is completed in the parking lot.

At any time during a period of snow emergency declared or during a snowstorm as defined and as provided in this Part, any person who shall park any type of motor vehicle anywhere upon or along the streets, public parking lots or portions thereof of the Borough of Mifflinburg as prohibited herein shall be guilty of a violation of this Part.
