For the purpose of this chapter, the following words and their derivations shall have the meanings given herein.
HANDBILL
Printed or written material which advertises goods or services.
LITTER
Garbage, refuse, rubbish and other waste material.
No person shall deposit or throw litter in or upon any gutter, street, alley, sidewalk, park or other public place except in public receptacles.
Persons placing litter in public receptacles shall do so in such a manner as to prevent it from being carried or deposited by the elements upon any street, alley, sidewalk or other public place or upon private property. No person shall use public receptacles for household litter or litter generated by businesses.
No person shall drive or move any truck or other vehicle within the town unless such vehicle is so constructed or loaded as to prevent any load, contents or litter from being blown or deposited upon any street, alley, sidewalk or other public place; nor shall any person drive or move any vehicle within the town, the wheels or tires of which carry onto or deposit in any street, alley or other public place mud, dirt, sticky substances, litter or foreign matter of any kind.
No person shall throw or deposit litter on any private property or commercial premises, whether owned by such person or not, except that the owner or person in control of such property or premises may maintain private receptacles for collection in such a manner that litter will be prevented from being carried or deposited by the elements upon any street, alley, sidewalk or other public place or upon any private property.
The owner or person in control of any private property shall at all times maintain the premises free of litter; provided, however, that this section shall not prohibit the storage of litter in private receptacles for collection.
Each owner or person in control of any commercial premises, including shopping centers and delivery and parking areas shall keep such places and other open areas free from litter; provided, however, that this section shall not prohibit the storage of litter in private receptacles for collection.
No person shall post or deposit a handbill upon an electric pole or within or upon a sidewalk, street, alley or other public place. The provision of this section shall not apply to newspapers deposited in newspaper sales boxes.
No person shall deposit a handbill in or upon any vehicle.
No person shall post, deposit or distribute a handbill in or upon any private premises which are uninhabited or vacant.
A. 
No person shall post, deposit or distribute a handbill in or upon private premises which are inhabited except by handing or transmitting such handbill directly to the owner, occupant or other person then present in or upon such private premises.
B. 
The provisions of this section shall not apply to the distribution of mail or to newspapers, except that newspapers shall be placed on private property in such a manner as to prevent their being carried or deposited by the elements upon any street, alley, sidewalk or other public place.
It shall be an offense for any person to fail to abide by this chapter, and any person found guilty thereof shall be subject to a fine not to exceed $250. Each day any violation of this chapter shall continue shall constitute a separate offense.
