A. 
There shall be a Sheriff, who shall be elected from the County at large. His or her term of office shall be four years from and including the first day of January next following his election.
B. 
No person shall serve as County Sheriff for more than 12 consecutive years.

A. 
The Sheriff, subject to the provisions of the Civil Service Law, shall appoint one Undersheriff and may appoint a second Undersheriff and such deputies, officers and employees of the Department as may be authorized by resolution of the County Legislature or by law. Except where inconsistent with this Charter, the Sheriff shall have and exercise all the powers and duties now or hereafter conferred or imposed by any applicable law.
B. 
When acting as the local licensing officer for firearms designated under § 265.00, Subdivision 10, of the New York Penal Law, the Department will not impose any restrictions, limitations or requirements on licenses or licensees other than those restrictions, limitations or requirements set forth in § 400.00 of the New York Penal Law.

In the event that the Sheriff shall appoint a second Undersheriff, then the Sheriff shall immediately designate, in writing, and file with the County Clerk which of the two Undersheriffs shall succeed to the office of Sheriff during the Sheriffs absence or inability to act or when a vacancy occurs in the office of Sheriff, in accordance with the applicable provisions of County Law § 652, Subdivision 1.

A. 
If the office of the County Sheriff becomes vacant other than by expiration of term, the vacancy shall be filled for the unexpired term at the first general election at which the vacancy may be filled.
B. 
Until the vacancy is filled by election as hereinabove provided, the vacancy shall be filled by appointment of a qualified person by the County Executive with the approval of the County Legislature.
