GENERAL REFERENCES

A.
The Legislature hereby finds and determines that certain new technology
has been put into operation at the Suffolk County Real Property Tax
Service Agency, and through the enhancement of this technology new
services could be offered in the future.
B.
This Legislature further finds and determines that the Director of
the Suffolk County Real Property Tax Service Agency has recommended
that the following convenience fee schedule be established for computer
Internet access to its advanced real estate information system (hereinafter
known as "AREIS") and has recommended that additional services be
added as soon as technology allows.
C.
This Legislature further finds and determines that the establishment
of convenience fees for access to such real property information via
the Internet is necessary to cover costs incurred by the Suffolk County
Real Property Tax Service Agency to prepare and maintain the tax maps
and the information related to those maps as required by law, which
will considerably reduce the financial burden on the County.
D.
Therefore, the purpose of this article is to establish annual convenience
fees for use of the Suffolk County Real Property Tax Services Agency
AREIS database via the Internet.
A schedule of fees for Internet subscription services within
the Suffolk County Real Property Tax Service Agency is hereby established
as follows. The annual convenience fees described below shall be paid
at the time of subscription. The annual subscriptions for access to
AREIS via the Internet, authorized below, shall run for a term of
one year from the commencement date of the subscription. Convenience
fees to be charged municipalities, other than tax assessors, shall
be a reduced fee from those listed below. Suffolk County's Town
and Village Tax Assessors shall not be charged a fee for the below
services.

Annual convenience fee for connection to Suffolk County Real Property
Tax Service Agency's Advanced Real Estate Information System,
AREIS, via the Internet:

The fees established pursuant to Resolution No. 161-2003 and
all other fees referred to in the third "Resolved" clause therein
are hereby ratified and confirmed and shall continue to be in full
force and effect from the dates of their adoption, amendment and/or
modification.

A.
This Legislature hereby finds that commercial entities are currently
selling access to lis pendens records currently available in Suffolk
County's public records at fees substantially higher than what
could be accessed through the County.
B.
This Legislature hereby finds and determines that the Real Property
Tax Service Agency and the County Clerk have reached a compromise
agreement, with respect to public access to lis pendens filed in the
Office of the County Clerk, that will permit the lis pendens records
of the County Clerk to be merged with the tax map images of the Real
Property Tax Service Agency, thereby making such records available
to the public at a more affordable and competitive rate than is currently
the case.
C.
Therefore, the purpose of this article is to conform existing County
law to this new agreement.

A fee schedule for Internet access services, within the Office
of the Suffolk County Clerk, is hereby established as follows:

A.
The Director of the Real Property Service Agency and the County Clerk
are hereby authorized and empowered to enter into a license agreement
to fully integrate their data systems with respect to public access
to lis pendens records. The lis pendens fees shall be collected by
the County Clerk's office and may be collected in the form of
credit card reimbursements, to be processed by an approved New York
State Office of General Services contractor, which shall be remitted
to the County Clerk's office on a thirty-day basis, and deposited
with the County Comptroller, as part of the general fund.

B.
For budgetary line-item presentation purposes, the fees shall be
attributable to the County Clerk and the office of the Real Property
Tax Service Agency in equal shares.
The provisions of this article shall apply to all subscriptions
occurring on or after the 60th day immediately subsequent to the effective
date of this article.
