Editor's Note: Res. No. 1152-2001, adopted 11-20-2001, extended all of the provisions of Res. No. 1003-1996 to any County employee called up for military service as a Reservist or National Guardsman as a result of the 9-11-2001 anti-American terrorist attack at the Twin Towers of the World Trade Center in New York City; the Suffolk County Executive and the Suffolk County Personnel Officer were authorized and directed to implement a policy of continuation of health insurance coverage at County expense for County employees who are members of the United States military reserves and the National Guard and who have been or will be called up to active duty in the near future as a result of said 9-11-2001 anti-American terrorist attack.
A. 
The County Executive is hereby authorized and empowered to renegotiate, where necessary, existing collective bargaining agreements between the County of Suffolk and any recognized or certified County employee organization for the purpose of prepaying, in one lump sum, all or a portion of the payout of accrued sick leave, vacation time or other unused personal leave days, compensatory time, overtime pay, payment for holidays and special days and any other compensation, as the case may be, under any provision of any pertinent collective bargaining agreement, to any County employee who is called up for military service as a military reservist or National Guardsman as a result of these actions and other military activities whose service as such exceeds 30 consecutive days, said payment not to exceed $20,000, anything in any pertinent collective bargaining agreement to the contrary notwithstanding.
B. 
Any exempt County employee who is called up for military service as a military reservist or National Guardsman as a result of these actions and other military activities, whose service as such exceeds 30 days, shall receive the same prepayment benefit as set forth in Subsection A above, anything in Chapter 935 of the Suffolk County Code to the contrary notwithstanding.

The County Executive is hereby authorized and empowered to renegotiate, where necessary, existing collective bargaining agreements between the County of Suffolk and any recognized or certified County employee organization for the purpose of permitting individuals called up for military service as a military reservist or National Guardsman as result of these actions and other military activities to fully exhaust accrued sick leave prior to implementation of the payout provisions of § 935-19A and B of this article and also for the purpose of ensuring that any such individual shall be treated as being on active-duty pay status during his or her absence from the County as soon as he or she commences his or her tour of duty regardless of his or her payroll status in Suffolk County for the purposes of receiving compensation, salary, payouts, fringe benefits, health benefits or other County benefits from Suffolk County as an employer, anything in any pertinent collective bargaining agreement to the contrary notwithstanding and anything in any other resolutions to the contrary notwithstanding.
B. 
Any exempt County employee who is called up for military service as a military reservist or National Guardsman as a result of these actions and other military activities, whose service as such exceeds 30 days, shall receive the same prepayment benefit as set forth in Subsection A above, anything in Chapter 935 of the Suffolk County Code to the contrary notwithstanding.

The County Executive is hereby authorized and empowered to renegotiate, where necessary, existing collective bargaining agreements between the County of Suffolk and any recognized or certified County employee organization for the purpose of authorizing County employees not serving in such military actions and activities to transfer all or a portion of their pay-out of accrued sick leave, vacation time, or other unused personal leave days, compensatory time, overtime pay, payment for holidays and special days and any other compensation, as the case may be, under any provisions of any pertinent collective bargaining agreement, to any County employee who is called up for military service as a military reservist or National Guardsman as a result of these actions and other military activities, whose service as such exceeds 30 consecutive days, said payment not to exceed $20,000, anything in any pertinent collective bargaining agreement to the contrary notwithstanding.
B. 
Any exempt County employee, who is not a military reservist or National Guardsman called up for such military actions and activities, shall be entitled to participate in this program and transfer to any County employee who is called up for military service as a military reservist or National Guardsman as a result of these actions and other military activities, whose service as such exceeds 30 days, the same prepayment benefit as set forth in Subsection A above, if agreed to with a participating County employee, anything in Chapter 935 of the Suffolk County Code to the contrary notwithstanding.

The County Executive is hereby authorized and empowered to renegotiate, where necessary, existing collective bargaining agreements between the County of Suffolk and any recognized or certified County employee organization for the purpose of providing to any County employee who is called up for military service as a military reservist or National Guardsman as a result of these actions and other military activities, whose service as such exceeded 30 consecutive days, payment of the difference between any salary or compensation such individual receives from the federal government for such military service during such period of service and the salary or compensation such individual would have received if he or she had continued to be compensated by the County of Suffolk during such period of service, said payments to be calculated from the expiration of the 30 days of consecutive service referred to above through up to one year of actual military service subsequent to the expiration of that thirty-day period, anything in any other resolutions to the contrary notwithstanding, and also for the purpose of providing such individuals with a no-layoff provision covering the period of said individual's actual military service through six months subsequent to the expiration date of such actual military service, anything in any pertinent collective bargaining agreement or other resolution to the contrary notwithstanding.
B. 
Any exempt County employee who was called up for military service as a military reservist or National Guardsman as a result of these actions and other military activities, whose service as such exceeded 30 days, shall be entitled to receive the same compensation and job security benefits as set forth Subsection A above, anything in Chapter 935 of the Suffolk County Code to the contrary notwithstanding, whether or not the pertinent collective bargaining agreements referred to above are so amended.
A. 
All other fringe benefits extended to any such employees covered by a collective bargaining agreement with a pertinent recognized or certified County employee organization shall remain applicable and in full force and effect.
B. 
Fringe benefits extended to any exempt employees under Chapter 935 of the Suffolk County Code shall remain applicable and in full force and effect.
The Director of Labor Relations is hereby authorized, empowered and directed to issue and promulgate such regulations as shall be necessary to implement the provisions of this article.
The benefits granted by this article shall be applicable to anyone on active duty as of the effective date of this article.
