Shade trees — See Ch. 392.
A three-member Shade Tree Commission is hereby created in and
for the Borough of Paxtang. The said Commission shall be constituted
as provided by law and shall perform all duties and may exercise all
the powers conferred by law upon borough shade tree commissions, provided
that the persons constituting the Shade Tree Commission now functioning
in the Borough shall constitute the Shade Tree Commission created
by this section, and nothing in this section shall affect the tenure
of any member of that Shade Tree Commission. All vacancies afterward
occurring in the Shade Tree Commission shall be filled in accordance
with the applicable provisions of the law.
The Shade Tree Commission shall have limited authority, as set
out in Section 2721 of the Borough Code,[2] to assess penalties for the violation of its regulations
and of Chapter 27, Subchapter B of the Borough Code, so far as it
applies to shade trees.
