The following words and phrases, unless the content specifically indicates otherwise, shall have the following meaning:
ROLLER SKATES
Shoes or similar frame devices fitted to or as a part of footwear with a set of two or more wheels, in tandem or otherwise, for the purpose of skating, or such similar devices, also known as and including in-line skates and roller blades.
SCOOTER
A vehicle propelled by human or mechanical power consisting of material or portion of material formed in a narrow footboard mounted between or atop two or more wheels, in tandem or otherwise, with an upright steering handle attached to the front wheel(s), or similar device.
SKATEBOARD
A vehicle propelled by human power and gravity consisting of material or portion of material formed in a thin firm sheet with wheels attached to the underside.
It shall be unlawful for any person to ride upon a scooter, engage in skateboarding, roller-skating, in-line skating, roller-blading, or ride upon or propel any skateboard, scooter or roller skates, upon the following streets and sidewalks within the Borough at any time:
A. 
29th Street and the sidewalk along 29th Street.
B. 
Derry Street and the sidewalks along Derry Street.
C. 
Wilhelm Road and the sidewalks along Wilhelm Road.
D. 
Paxtang Avenue and the sidewalks along Paxtang Avenue.
E. 
Park Terrace and the sidewalks along Park Terrace.
F. 
All Borough property.
It shall be unlawful for any person to ride upon a scooter, engage in skateboarding, roller-skating, in-line skating or roller-blading, or ride upon or propel any skateboard, scooter or roller-skating devices upon any public thoroughfare, street, sidewalk and municipal lot in the Borough:
A. 
Between sunset and sunrise on any day.
B. 
At any other time when, due to insufficient light or unfavorable atmospheric conditions, persons are not clearly discernible from a distance of 100 feet.
A. 
A person engaged in skateboarding, in-line skating, roller-blading or riding upon a scooter or similar device shall obey the instructions of a police officer or other appropriately attired person authorized to direct, control or regulate traffic.
B. 
A person engaged in skateboarding, roller-skating, in-line skating, roller-blading, or riding upon a scooter or similar device shall obey traffic and pedestrian control signals as provided under Pennsylvania Motor Vehicle Code, Section 3112 (relating to traffic-control signals) and Section 3113 (relating to pedestrian control signals).
A. 
Any person upon roller skates or riding on or by any means of a skateboard, scooter, roller skates, in-line skates or similar device on any sidewalk or right-of-way not open to public vehicular traffic shall exercise due care and shall yield the right-of-way to pedestrians.
B. 
No person shall go upon roller skates, in-line skates or ride on or by means of a skateboard, scooter or similar device on any sidewalk or right-of-way not open to public vehicular traffic at a speed greater than is reasonable and prudent, having due regard for pedestrian traffic, and in no event at a speed which endangers the safety of persons or property.
C. 
The person engaged in skateboarding, roller-skating, in-line skating, roller-blading or riding upon a scooter or similar device shall exercise due care, yield the right-of-way to any pedestrian, and may not overtake or pass a pedestrian while riding upon or propelling the skateboard, roller skates or scooter. The operator of such skateboard or scooter shall dismount from the skateboard or scooter and shall pass or overtake the pedestrian on foot, or wait until the pedestrian passes, prior to remounting the skateboard or scooter.
No person riding upon a scooter or engaged in skateboarding, roller-skating, in-line skating or roller-blading shall suddenly leave a curb, sidewalk, berm or street or any other place of safety and ride upon or propel into or toward the path of any vehicle which is so close as to constitute a hazard. Where there are no pedalcycle lanes, persons engaged upon a scooter, skateboarding, roller-skating, in-line skating or roller-blading upon a roadway shall ride as near to the right of the roadway as practical, exercising due care when passing a standing vehicle or one proceeding in the same direction.
No person shall place a ramp, half-pipe or other structure used for skateboarding, roller-skating, in-line skating, roller-blading or use for scooters in any public thoroughfare, street, upon a sidewalk or municipal parking lot in the Borough.
The provisions of this chapter shall not apply and nothing herein shall prohibit the use of skateboards, roller skates, scooters or similar devices in and part of permitted parades, commercial promotions, Borough events or other public events authorized by Borough Council.
Any person who violates any provision of this chapter shall, upon conviction thereof:
A. 
First offense. The skateboard, scooter, roller skates or in-line skates used in violation of this chapter shall be impounded by the Police Department of the Borough for a period not exceeding 15 days. If the person violating the chapter is a minor, as defined in § 175-3 of the Code, in addition to the confiscation of the skateboard, scooter, roller skates or in-line skates as aforementioned, the Borough Police shall notify the parents, guardian or other person having legal custody of said minor in violation of this chapter of the impounding of the skateboard, scooter, roller skates or in-line skates. In addition, said individual shall be provided with a copy of this chapter.
B. 
Second and/or subsequent offense. The skateboard, scooter, roller skates or in-line skates of any person violating the provisions of this chapter for the second and/or a subsequent time shall be impounded by the Police Department of the Borough for a period not exceeding 30 days and said person shall, upon conviction, be sentenced to pay a fine of $50 and costs. In the event that person is a minor, the skateboard, scooter, roller skates or in-line skates of that minor shall be impounded by the Police Department of the Borough for a period not exceeding 30 days, and the parent, guardian or other person having legal custody of that minor shall be, upon conviction, sentenced to pay a fine of $50 and costs.
